BACKGROUND:
On October 1, 2020, following the completion of a competitive procurement process, the County entered into an agreement with Redwood Toxicology Laboratory, Inc. to provide blood and urine testing services for prosecution cases. Redwood Toxicology Laboratory, Inc. was selected through a Request for Proposals process conducted in 2020, in an amount not to exceed $140,000, with a term of October 1, 2020 through September 30, 2023, and an option to extend for two more years.
On October 1, 2023, the parties amended the Agreement (“Amendment 1”) to extend the term through September 30, 2025, and to increase the maximum amount payable under the Agreement by $59,999, to an amount not to exceed $199,999.
On March 1, 2024, the parties amended the Agreement a second time (“Amendment 2”) to replace Exhibit B to change the description of drugs covered.
DISCUSSION:
The County’s current Agreement with Redwood Toxicology Laboratory, Inc. provides the County with services for blood and urine testing has expired. To allow the County to conduct a competitive procurement to evaluate current market offerings, staff recommends a 6-month extension to the Agreement. This extension will allow time for the County to develop and conduct a comprehensive request for proposals (RFP) process to identify and select a qualified service provider for these services, while ensuring continued use of the Redwood Toxicology Laboratory testing services for prosecution cases.
It is in the best interest of the County that the Agreement be amended a third time to extend the term through March 30, 2026, increase the maximum amount payable by $30,000 to a new total amount not to exceed $229,999, replace Exhibit B to reflect the adjusted price schedule. The Procurement Manager has approved a waiver request to permit a contract term of this duration.
This third amendment to the Agreement and resolution have reviewed and approved by the County Attorney’s office as to form.
COMMUNITY IMPACT:
Services provided by this contract allow testing blood samples for controlled substances and other types of drugs, which is a necessary step in the investigation of driving under the influence cases where their use is suspected. Additionally, it can produce significant evidence in other types of investigations, including homicides and sexual assaults. The results of this testing could provide both evidence to be used in the prosecution of these cases, as well as evidence that could serve to mitigate or exonerate. All jurisdictions within our County will benefit, as enhanced accountability for drug-impaired driving serves as a deterrent, encouraging responsible behavior and helping reduce the frequency of dangerous impaired-driving incidents. A reduction in such incidents lowers risks for all roadway users, including families, pedestrians, and other motorists.
FISCAL IMPACT:
The maximum amount payable by the County under this third amendment to the Agreement is increased by $30,000 to a total amount not to exceed $229,999. Funds for this Agreement have been included in the FY2025-26 Adopted Budget.
