Adopt a resolution waiving the Request for Proposals (RFP) Process and authorizing the District Attorney to execute a five year agreement with Axon Enterprise, Inc to continue using the application programming interface (API) that enables access between Axon’s platform, evidence.com, and Prosecutor by Karpel, for the term of June 1, 2025 through May 31, 2030, in an amount not to exceed $829,173.

BACKGROUND:
In 2018, the District Attorney’s Office (DAO) recognized the need for a digital evidence storage solution that would also allow for the receiving of files electronically. After much research and discussions with the local law enforcement agencies within San Mateo County, Axon Enterprise was identified as providing the most comprehensive solution. Axon Enterprise’s API and the District Attorney’s Office case management system were able to integrate which allowed for the viewing of the digital evidence directly from the DAO case management system. Because of the integration, there is an increase in productivity for the DAO staff due to not having to view evidence in two systems. For the initial use of Axon Enterprise’s API, there was no cost for its usage and storage solution.
DISCUSSION:
It is in the best interest of the County to waive the Request for Proposals (RFP) Process, as the services are being access through a cooperative agreement and that the lead agency was a governmental entity and it is a continuation of an ongoing service, both of which are exemptions to the RFP process. A five-year contract quote was requested for better cost certainty. With this contract, the County will continue using a known product, there would be no training costs and loss in productivity incurred by renewing. Therefore, it is in the best interest of the County to renew this contract for five years. Approval of the resolution will allow the District Attorney’s office to continue to provide its attorneys with direct access to digital evidence within our case management system and provide an effective tool for the prosecution of criminal cases.
This contract with Axon references an “Intent to Piggyback Off Cooperative Procurement” which is Axon’s contract with Omnia-The University of Nebraska, which is the Master agreement between Axon and Omnia, contract no. 3544-21-4615. This “piggybacking” addendum incorporates by reference the terms of contract between Axon and Omnia into the County’s proposed renewal contract with Axon. Axon is the entity that has contracted with Omnia to deliver the goods and services owned by Omnia to state and local agencies such the County. An important feature of this “Intent to Piggyback” addendum is that it expressly states at number 1 on the first page that “Exhibit A- Service provider Supplemental Attachment (which is the County’s Supplemental Agreement with our terms and reviewed by Risk Management) is incorporated into this Agreement.”. This means that in the event of any conflict, the County’s terms shall prevail.
County Attorney has reviewed and approved the resolution as to form.
COMMUNITY IMPACT:
Services provided by this contract allow additional features such as the ability to have all audio and video files automatically transcribed; the ability to create portals for law enforcement agencies that don’t have Axon and the ability to have proprietary audio and video files automatically converted into evidence.com.
FISCAL IMPACT:
The term of the contract is from June 1, 2025, through May 31, 2030 for a total obligation of $829,173. The funds for the first two years have been included in the FY25-27 Recommended budget.
