Subject: Amendment to the Agreement with Joint Venture Silicon Valley Network

Adopt a resolution authorizing:
A) The execution of an amendment to the agreement with the Joint Venture Silicon Valley Network for data index information services, extending the term by three years through April 30, 2029, and increasing the County’s maximum fiscal obligation by $200,000, for a new total amount not to exceed $400,000; and
B) A waiver of competitive procurement.

BACKGROUND:
Joint Venture Silicon Valley (JVSV) Network has been providing nationally recognized comprehensive analyses of Silicon Valley trends since 1995 by tracking over 60 quantitative measures of relevance to the economy and community health. These indicators provide critical insights into economic vitality, workforce dynamics, poverty levels, and other community reference points across the broader Silicon Valley region. The JVSV data can be used for research and benchmarking purposes as well as a resource for policy decision making.
The JVSV Network generally publishes data on the broader Silicon Valley region, which includes San Francisco, San Mateo, and Santa Clara counties, without disaggregated San Mateo County-specific data. Such County-specific data is useful to inform countywide strategic planning, policy evaluation and performance measurement, and to better understand the needs of the communities in San Mateo County.
On May 1, 2023, the County entered into an agreement with JVSV to generate San Mateo County specific data based on the Silicon Valley Index (the “Agreement”). Under the terms of the Agreement, JVSV provides updated, County-specific data on 60 measures each year for three years, with a two-year extension option. Under the Agreement, the County’s maximum payment obligation is $200,000 for three years of data.
The County-specific research data provided by JVSV has been regularly utilized by CEO staff, including Budget, Performance, & Policy and the Office of Labor Standards, to inform various County policies and implementation strategies.
Given JVSV’s unique role in collecting, analyzing and generating indicator data sets in Silicon Valley, staff determined that there is no other entity that has the knowledge and experience to facilitate the disaggregation of their collected data to generate San Mateo County-specific information. As a result, the contract was considered a sole source procurement, exempt from competitive procurement requirements.
DISCUSSION:
The term of the County’s current Agreement with JVSV is set to expire next year, and staff recommends that the County amend the Agreement to secure continued access to JVSV’s research data for an additional three years. The proposed amendment would extend the Agreement term through April 30, 2029, and increase the not-to-exceed amount by $200,000 for a new total of $400,000. This amendment will ensure continuity in the provision of critical data used by the County to inform countywide strategic planning, policy evaluation and performance measurement.
The Procurement Department has approved a waiver of the standard five-year term for County agreements to allow the proposed amendment.
Procurement has also approved a waiver of competitive procurement for this first amendment to the Agreement. Staff recommends that the Board find that waiver of competitive procurement is in the best interest of the County.
The County Attorney has reviewed the proposed amendment and resolution as to form.
COMMUNITY IMPACT:
This data will be accessible to all Departments including the Office of Equity and Social Justice and will be used to better understand the needs of our diverse communities and inform strategic policy planning to improve the quality of life for those living and working in San Mateo County.
FISCAL IMPACT:
The County’s maximum fiscal obligation under the amended Agreement shall not exceed $400,000 and is allocated in the FY 2025-2026 Non-Departmental Services budget.
