Acting as the Governing Board of the Fair Oaks Sewer Maintenance District, adopt a resolution:
A) Authorizing execution of a supplemental agreement between the Town of Woodside and the Fair Oaks Sewer Maintenance District for the transfer of one sewer connection in the Redwood Creek Main Trunk Sewer and Glens Collection System Assessment District; and
B) Directing the Director of Public Works to transmit a copy of the resolution with the appropriate agencies.

BACKGROUND:
The Fair Oaks Sewer Maintenance District (District) entered into an agreement with the Town of Woodside (Town) on April 2, 1968 (Agreement) for the provision of sewage transmission and disposal of wastewater collected through the District facilities for properties within the corporate limits of the Town and within the Town’s Redwood Creek Main Trunk Sewer and Glens Collection System Assessment District (Assessment District). The subject property is within the Town and inside the original Assessment District boundary.
The Agreement provides that no parcel exterior to the boundary of the Assessment District nor parcels split and creating additional building sites shall be permitted to connect to the sewer system acquired or constructed by the Assessment District without first obtaining the approval of both the Town and the District.
At the time of the initial assessment, one shared sewer service connection assessment was levied on three parcels in common ownership, identified as Assessor’s Parcel Numbers (APN) 073-061-100, 073-061-110 and 073-061-120, such that APN 073-061-120 was assessed the equivalent of 25 percent of a full assessment and the remaining parcels were each assessed 25 percent and 50 percent of a full assessment. However, the full connection has been used by APN 073-061-120, leaving the other two parcels without any assessment. The three parcels remain in common ownership and the owners have merged APNs 073-061-100 and 073-061-110 to create APN 073-061-250.
DISCUSSION:
Scott and Celestine Schnugg are the current owners of the property identified as APN 073-061-250 and have requested that the property be granted a sewer connection in order to receive sewer service.
To maintain the integrity of the purchased sewer treatment capacity of the Assessment District, the Town has transferred a sewer connection to APN 073-061-250 from the unused sewer connections assigned to Parcel Number 70 of the Assessment District by adopting Resolution No. 2024-7705 on September 10, 2024 (attached), which also authorizes the Town Manager to execute a supplemental to the Agreement.
The District is able to provide sewer service to the property with the sewer connection granted by the Town. Therefore, the Department recommends this Board approve the execution of the supplemental agreement.
This Board authorizing the execution of a supplemental agreement to provide a sewer connection can result in the District providing sanitary sewer service to a parcel in a suburban area that would otherwise use an "on-site" method to handle wastewater, which could have an impact on the environment and neighboring residents.
County Attorney has reviewed and approved the resolution and supplemental agreement as to form.
FISCAL IMPACT:
The property owners have paid or will pay all required fees for the parcel as follows:
• District Connection Fee: $5,960
• Plan Review Fee: $300
• Sewer Inspection Permit Fee: $300
• Miscellaneous Services Fee: $200
If the supplemental agreement is approved, the property owners will be subject to the annual sewer service charge levied by the District, which has been set for $1,095 for FY 2024-2025. The property owners will construct and pay for the sewer lateral that is necessary to bring sewer service to this property.
There is no impact to the General Fund.
