BACKGROUND:

 

Measure K is the half-cent general sales tax initially approved by San Mateo County voters in November 2012 and extended in November 2016 for a total of thirty years. 

 

The Board of Supervisors (Board) held study sessions on Measure K expenditures and approved funds for the fiscal year (FY) 2024-25 budget cycle, divided evenly among the five supervisorial districts, for one-time district-discretionary needs and projects. District 2 has submitted a request to use their district-discretionary Measure K funds as shown below and described in the Project Summary section of this memorandum:

This item is consistent with the criteria for district-discretionary Measure K funds approved by the Board in December 2018. District 2 indicates that this organization is either a public agency operating within the County or a nonprofit organization registered and in good standing with the California Attorney General. District 2 indicates that the sponsoring Board member, member’s family, and member’s supervisorial staff do not serve as an officer, director, or play a policy role for the grantee organization.

 

PROJECT SUMMARY:

This is a request to authorize a grant to Immigration Institute of the Bay Area, and resulting grant agreement, in an amount not to exceed $20,000, to provide for immigrant legal services for District 2 residents The County Executive’s Office will administer and manage the proposed agreement.

District-discretionary Measure K funding for this organization has previously been provided as listed below: 

 

                     On May 23, 2023, the Board of Supervisors approved district-discretionary Measure K funding, in the amount of $30,000, for Immigrant Legal Services for County residents.

Immigration Institute of the Bay Area (IIBA) Redwood City offers immigration legal consults to low-income immigrant residents of San Mateo County. IIBA services are provided by experienced, licensed immigration attorneys and by trained and U.S. Department of Justice (DOJ) immigration representatives. In addition to consults, IIBA offers full legal representation to low-income community members in their immigration applications each month including family petitions, DACA renewals, U and T visas; VAWA applications, consular processing cases, green card renewals, citizenship cases, affirmative asylum cases, civics education, voter registration and community education and outreach.

 

This district-discretionary grant will be used to fund the following project or services:

                     The Directing Attorney will manage the program, supervise and mentor attorneys and staff, review immigration cases, offer guidance and support to the legal team in handling individual client matters, and ensure quality and compliance.

                     The Case Manager will help clients navigate the often complex legal and social systems related to immigration, ensuring they receive the services, resources, and advocacy require. This will include conducting initial interviews, managing case documentation, referring clients to legal services, monitoring case progress, assisting with document preparation and reporting, and supporting attorneys.

                     Rent includes all necessary costs to rent office space and ensure IIBA offices are maintained and functional including space, utilities, maintenance, security, and costs related to the physical space the organization occupies.

                     Operating Expenses, including communications (phone/internet), equipment lease & maintenance, insurance, postage & delivery and professional fees.

 

When working with clients, IIBA staff will review each consultee or client's unique immigration history and will provide an analysis of the best immigration option available for the individual. IIBA legal workers will provide a full assessment to screen for the consultee's eligibility for other immigration remedies which are available, including eligibility for new, lesser-known programs.

 

This district-discretionary grant will be used to fund the following project or services:

 

District 2 has informed the grantee organization that this is one-time only, and that the grantee organization will need to find other sources of funding going forward.  The grantee organization will use the Measure K grant as follows:

Additional funding is anticipated from the California Department of Social Services, Crankstart Foundation, Chan Zuckerberg Initiative and the Atkinson Foundation.

The release of funds will be contingent on the execution of an agreement providing for the County’s confirmation of the expenditure of funds for the purposes stated herein. The County will disburse the funds to the following organization for the purposes described above:

IIBA will provide at least 12 community education and outreach events in communities in District 2 by December 31, 2025. These outreach events will consist of either a presentation on available remedies in immigration law; immigration consults; a know your rights presentation; recent updates and developments in immigration law; or a combination of these services.

Legal representation and immigration history analysis will be provided to 50 new (not current) District 2 clients regarding their immigration status by December 31, 2025.

The County Attorney’s Office has reviewed and approved the agreement and resolution as to form.

 

EQUITY IMPACT:

Expanding IIBA’s capacity to provide immigrant legal services ensures that vulnerable immigrant residents, including low-income families, unaccompanied minors, and single heads of household, can access critical support and navigate complex immigration challenges. By serving low-income immigrant communities, IIBA’s legal support ensures that regardless of their economic status or prior access to legal information, immigrants can navigate legal processes, protect their rights, and participate fully in our community.

 

FISCAL IMPACT:

There are sufficient Measure K funds for this specific FY 2024-25 Measure K request. These funds are budgeted in the Non-Departmental Services FY 2024-25 Adopted Budget.
