RECOMMENDATION:

Adopt a resolution authorizing:
A) The President of the Board to execute an agreement with Interstate Grading and Paving, Inc., for the Coyote Point Eastern Promenade Rejuvenation Project, in the amount of $5,517,877.15; and
B) The Director of Public Works to execute subsequent change orders to grant time extensions for project completion and payment up to a maximum aggregate amount not to exceed $551,787.85, or approximately 10 percent of the agreement amount.

BACKGROUND:
On August 26, 2009, the Parks Department (Parks) certified an Initial Study/Mitigated Negative Declaration (IS/MND) for the Coyote Point Recreation Area Shoreline and Promenade Improvement Project. The IS/MND evaluated improvements for both the western and eastern promenades in the Coyote Point Recreation Area. On June 2, 2016, Parks approved an Addendum to the IS/MND, which included updates to the California Environmental Quality Act (CEQA) analysis and Mitigation Monitoring and Reporting Plan (MMRP) requirements based on the proposed improvements for the Coyote Point Eastern Promenade Rejuvenation Project (Project). There have been no substantial changes to the Project since the Addendum to the IS/MND was approved and Parks staff has determined that this Project complies with the California Environmental Quality Act (CEQA).
On December 8, 2020, this Board adopted Resolution No. 077914, which adopted the plans and specifications, including conformance with prevailing wage scale requirements and called for sealed proposals for the Coyote Point Eastern Promenade Rejuvenation Project.
DISCUSSION:
On Thursday, January 28, 2021, bids were accepted for the Project and subsequently referred to Public Works for checking and recommendation. The bid of:

at $5,517,877.15 was the lowest responsible bid received for the work. The Engineer’s Estimate was $7,633,700. A summary of the bids received is attached as Exhibit “A”.
County Counsel has reviewed and approved the resolution as to form.
FISCAL IMPACT:
The estimated cost for construction is $6,069,665.00 which includes authorization for up to $551,787.85 in change orders as the work is bid on a unit price basis. The contingency is used to pay the contractor for any unforeseen conditions not anticipated in the construction agreement documents. Funds from Excess ERAF, Measure K, and donations have been allocated in the Capital Projects Budget for this Project.
