A)                     Accepting the certificate of the Chief Elections Officer as the statement of the results of the vote as determined by the official canvass of the November 5, 2024 Presidential General Election; and

 

B)                     Declaring the persons elected to, or nominated for, certain offices; and

 

C)                     Declaring the results of a local ballot measure.

BACKGROUND:

On November 5, 2024, the Chief Elections Officer administered the Presidential General Election (“Election”). The official canvass and an abstract or Statement of the Vote for the Election were completed and certified by the Chief Elections Officer and are now available at the Registration & Elections Division (40 Tower Road, San Mateo). An electronic copy of the Statement of the Vote is also published on the Registration & Elections Division website, www.smcacre.gov, and a copy has been submitted to the Board, as required by state law. 

 

DISCUSSION:

Under California law, the Chief Elections Officer, within 30 days of an election, is required to inspect, process, and count all ballots cast during an election and prepare a certified statement of the results.

 

Upon acceptance of this Certification of the Election, Elections Code Section 15400 directs the Board of Supervisors, as the governing body of the jurisdiction, to declare elected or nominated to each office voted on at the Election the persons having received the highest number of votes for such office, or the person who was otherwise duly elected or nominated.

 

On November 5, 2024, a Special Election within the Pescadero Municipal Advisory Council Area was consolidated with the Election. This Board will be accepting the certificate of the Chief Elections Officer as the statement of the results of the vote.

 

Staff recommends that the Board accept the certificate of the Chief Elections Officer as the statement of the results of the vote as determined by the official canvass of the Election. 

 

In the proposed Resolution, persons will be declared elected to the following offices: one (1) Member of the Board of Supervisors for 4th Supervisorial District; three (3) Members of the County Board of Education Trustee Areas 4, 5 and 6; one (1) Member of the San Mateo County Community College District Trustee Area 1; five (5) Members of the Pescadero Municipal Advisory Council; and nine (9) San Mateo County Superior Court Judges.

 

In addition, there are appointments in lieu of holding elections for the County Board of Education Trustee Area 7 and for San Mateo County Community College District Trustee Areas 3 and 5. 

 

The County Attorney has reviewed and approved the resolution as to form.
