Acting as the Governing Board of County Service Area No. 8, adopt a resolution setting Tuesday, August 13, 2024, at 9:15 a.m. at the regularly scheduled Board of Supervisors meeting as the time and place for a public hearing on the filing of the Garbage and Recyclables Collection Service Charges Report for County Service Area No. 8 (North Fair Oaks) for fiscal year 2024-25.

BACKGROUND:
On October 20, 2009, this Board adopted Resolution No. 070423, which approved a franchise agreement with Recology San Mateo County (Recology) to provide services for the collection of recyclable materials, organic materials, and garbage from January 1, 2011 through December 31, 2020. On June 4, 2019, this Board adopted Resolution No. 076641, approving the amended and restated Recology Franchise Agreement for an additional 15-year term expiring on December 31, 2035.
On January 23, 2024, this Board adopted Resolution No. 080117, setting the garbage and collection rates for County Service Area No. 8 (CSA-8). These same rates were applied and used for calendar year 2024.
DISCUSSION:
The County generates revenue to pay Recology for service to residential dwellings in CSA-8 by charging fees based on pick-up units for each affected parcel that meets the criteria outlined in County Ordinance Code 4.04.220. These fees are defined and adopted each fiscal year in the Collection Service Charges Report (Charges Report) and placed on the subsequent County tax roll. Recology directly bills commercial and industrial customers that do not have the charges placed on the County tax roll and customers receiving additional services pursuant to the franchise agreement.
The County Ordinance Code requires this Board to hold a public hearing to consider public testimony prior to adopting the Charges Report. The recommended action, adopting a resolution setting the time and place for the public hearing, is the first step in the process and is procedural.
Adoption of the Charges Report for fiscal year (FY) 2024-25 and its filing with the Clerk of the Board will result in the user charges contained therein being placed on the County tax roll for CSA-8. These charges will appear on the FY 2024-25 tax bill of each affected property and will be collected in the same manner as property taxes. The rates adopted by this Board on January 23, 2024 will be used to perform the calculation for the FY 2024-25 residential and multi-family dwelling charges that will appear on the property owner’s FY 2024-25 tax bill. Commercial parcels and additional services provided to customers will continue to be billed separately based on the current rates by Recology.
The remaining unincorporated county areas covered by the franchise agreement are billed directly by Recology and the garbage and recyclables collection service charges are not placed on the tax bill.
The County Attorney has reviewed and approved the resolution as to form.
FISCAL IMPACT:
There is no fiscal impact associated with the recommended action of setting a public hearing.
Staff time involved in preparing the Charges Report for CSA-8, administrative documents, and public advertisement of the hearing is part of the administrative cost associated with managing the garbage collection and recycling services in CSA-8 and is financed from franchised fees.
