Adopt a resolution authorizing the President of the Board of Supervisors to execute a First Amendment to the Agreement with Romtec, Inc. for Design-Build Services for the new restroom and interpretive pavilion building at San Bruno Mountain State and County Park, extending the term by two months through January 30, 2026, and increasing the amount by $97,670.43 for a new total amount not to exceed $1,138,725.43.

BACKGROUND:
San Bruno Mountain State and County Park (“San Bruno Mountain”) stands as a protected open space island in northern San Mateo County that provides habitat for a diverse array of plants and wildlife. The park, comprised of 2,416 acres of rugged terrain, offers exciting hiking opportunities with a nearly 10-mile-long trail network, a youth-group campground, day use picnicking facilities, and panoramic views of the San Francisco Bay Area. San Bruno Mountain’s unique natural resources, expansive trail system, and proximity to the cities of Brisbane, Daly City, South San Francisco, and Colma draws nearly 250,000 visitors every year, and the centrally located day use area serves as a gathering location for visitors having a picnic or preparing for a scenic hike.
To enhance the services offered at the park, the Parks Department (“Department”) formulated the San Bruno Mountain Day Use Improvement Project (“Project”). The Project consists of constructing a new restroom and open air interpretive pavilion building to replace the antiquated restroom building that had exceeded its useful life, nine new picnic sites (six of which will be accessible), and pathways to improve circulation. Collectively, these features will enable the Department to better educate the public on the sensitive resources native to San Bruno Mountain and offer the public an opportunity to picnic and enjoy time with family and friends.
Following a competitive procurement process to select a Design-Build Entity that could design and construct the new restroom and open air interpretive pavilion building at San Bruno Mountain, this Board, at its August 13, 2024 meeting, adopted Resolution No. 080577 and awarded a construction contract to Romtec Inc. (“Romtec”). The agreement with Romtec is for the term of August 13, 2024 to November 24, 2025, and for an amount not-to-exceed $1,041,055, which includes $50,000 (4.8%) in contingency amounts for authorized change orders.
DISCUSSION:
The above-described agreement obliges Romtec to design and deliver a turnkey facility at project completion. The scope of work includes: demolition and disposal of the antiquated restroom building; completion of all necessary site preparation and utility connections; installation of drainage and stormwater improvements; and design and construction of the new restroom and open-air interpretive pavilion building, including toilets, sinks, and ancillary improvements.
During construction, several project change orders were required to address changes to the project design and additional work that was outside of the scope of the original agreement. These project change orders represent a combined total of $122,670.43 in additional project costs, which exceeds the $50,000 construction contingency amount included in the agreement. The Department thus desires to amend the agreement with Romtec to increase the not-to-exceed amount by $97,670.43 ($122,670.43 in project change orders, less the original $50,000 contingency, plus a new $25,000 contingency), to a new total amount not-to-exceed $1,138,725.43. This new not-to-exceed amount will cover the above-described project change orders as well as includes an additional $25,000 in contingency fee amounts in case the Department needs to authorize additional change orders.
Final inspection of the Project has not yet occurred. To ensure any deficiencies identified during final inspection can be properly resolved, the Department desires to extend the term of the agreement to January 30, 2026.
The County Attorney’s Office has reviewed and approved the proposed agreement and resolution as to form.
COMMUNITY IMPACT:
The new restroom facility will be gender-neutral, allowing for a higher quality of service to be provided to all visitors. Moreover, while code requires that two of the restroom stalls meet accessibility standards, the Department has elected to make all four stalls accessible further advancing our commitment to the disabled community.
FISCAL IMPACT:
The original agreement with Romtec is for an amount not to exceed $1,041,055. This amount includes the design and construction of the restroom building, as well as a $50,000 construction contingency. The requested amendment increases the contract by $97,670.43 to address additional project costs in excess of the $50,000 construction contingency.
Non-Departmental Services will contribute $1,000,000 to the Project. The remaining amount, will be funded by Measure K. Sufficient appropriations are included in the Department’s FY 2025-26 Adopted Budget for this Project.
