A)                     The President of the Board of Supervisors to execute a fourth amendment to the Parks Department’s agreement with Execushield, Inc. for general security services at the Coyote Point Marina to increase the amount by $200,000 to an amount not to exceed $400,000; and

 

B)                     The Parks Director, or the Parks Director’s designee, to execute additional amendments to the Parks Department’s agreement with Execushield to modify the County’s maximum fiscal obligation by no more than $25,000, and/or to modify the agreement’s terms and/or services, so long as the modified term(s) and/or services is/are within the current or revised fiscal provisions.

BACKGROUND:

In 2021, the County of San Mateo conducted a competitive solicitation process to procure general security services. As a result of the solicitation, on or about July 19, 2021, the County entered into Agreement No. 17810-22-D00080 (the “Master Agreement”) with Execushield, Inc. (“Execushield”) by which Execushield agreed to provide County-wide security services. The Master Agreement contemplated that County departments would individually contract with Execushield for department-specific security services as needed.  Consistent therewith, in September 2021, the Parks Department (“Department”) entered into an agreement with Execushield (the “County Parks Agreement”) by which Execushield agreed to provide general security services at the Coyote Point Marina for a term ending August 30, 2024, and for an amount not-to-exceed $200,000.

 

The Department and Execushield have since entered into three amendments to the County Parks Agreement to, among other things, update the agreement’s fee schedule and extend the agreement’s term through August 30, 2026.  Separately, the County and Execushield have entered into amendments to the Master Agreement to extend its term, consolidate costs by location (including at the Coyote Point Marina), and make other modifications.

 

DISCUSSION:

To fund the extended term of the County Parks Agreement (as set forth in the amendments to the County Parks Agreement referenced above), the Department and Execushield desire to enter into a Fourth Amendment to the County Parks Agreement to increase the County’s maximum fiscal obligation by $200,000, for a new total amount not-to-exceed $400,000, with all other terms of the County Parks Agreement (including the August 30, 2026 termination date) remaining unchanged.

 

The County Attorney’s Office has reviewed and approved the amendment and resolution as to form and content.

 

EQUITY IMPACT:

Amendment of the agreement will enable the Department to continue to provide safe and enjoyable use of the Coyote Point Marina by park patrons and Marina tenants.

 

FISCAL IMPACT:

There is sufficient funding within the Coyote Point Marina’s FY 2024-25 Adopted Budget for this purpose. Since the Coyote Point Marina is an enterprise fund, there is no impact on the General Fund and no Net County Cost associated with this amendment. Costs for services will be budgeted accordingly in future fiscal years.
