BACKGROUND:

In March 2017, this Board considered recommendations for generational capital improvements to address, among other things: (1) reliance on increasingly outdated facilities and infrastructure; (2) high maintenance and operational costs; (3) overutilization of leased space that is subject to potentially uncontrolled cost growth; (4) rising environmental standards; and (5) service and programming improvements needed to better serve residents. 

 

This Board thereafter directed staff to pursue various capital projects including the Lathrop House Relocation, Parking Structure 2 (PS2), and County Office Building 3 (COB3), collectively referred to as the County Government Center Projects.

 

This Board subsequently approved the Campus Infrastructure Improvements Project (Infrastructure Project). The Infrastructure Project included, among other things, landscape, hardscape, and infrastructure improvements creating a cohesive campus, providing accessibility infrastructure, and increasing Americans with Disabilities Act (ADA) compliance. To avoid demolishing newly constructed infrastructure, the Infrastructure Project was to occur concurrently with work by the Department of Public Works to complete necessary waterproofing and repairs for the tunnel beneath the County campus.

 

DISCUSSION:

On June 5, 2018, this Board adopted a resolution authorizing an agreement with Truebeck Construction for the County Government Center Projects. The Agreement anticipated the phased setting of a guaranteed maximum price through amendments as design progressed, scope for the component projects was finalized, and trade contracts were competitively awarded.

 

In June 2020, this Board adopted a resolution authorizing an agreement with SOM as the new Architect of Record for the COB3 project. As the Project’s Architect of Record, the Project Development Unit (PDU) leveraged the COB3 architect team and subconsultants to provide initial design concepts for the Infrastructure Project.

 

On June 25, 2024, this Board adopted Resolution No.080465, which authorized the execution of an amendment and change orders to the existing Agreement with Truebeck to also provide for the completion of the Infrastructure Project for an amount not to exceed $6,100,000.

 

To align the Infrastructure Project with other work happening on the campus, PDU staff directed Truebeck to proceed with initial Project development phase work and Truebeck incurred expenses related to carrying out such work. On August 12, 2024, after receiving and reviewing updated cost estimates based on the more detailed Project design documents, PDU staff directed Truebeck to cease all work on the Infrastructure Project.  

 

The amendment incorporates the parties’ agreement to reimburse Truebeck all expenses incurred prior to cessation of work in the amount of $195,378. The Contractor has agreed to accept such sum and release and forever discharge the County from further liability in connection with the Campus Infrastructure Improvement Project. The County retains ownership of all work done by Truebeck, which will be preserved for later completion of the Infrastructure Project.

 

The PDU Interim Director and Project Team have reviewed and approved the amendment. County Attorney has reviewed and approved the amendment and Resolution as to form.

 

FISCAL IMPACT:

Total costs for this amendment will be funded from the FY 2024-25 Major Capital Construction Program Budget.
