BACKGROUND:

In September 2016, California Senate Bill (SB) 1383 (Lara, Chapter 395, Statutes of 2016) established statewide emissions reduction targets for short-lived climate pollutants which result from the landfilling of organic waste. SB 1383 requires the State to reduce the amount of organic waste disposed of in landfills by 75 percent from 2014 levels by 2025. The State has established mandates for local jurisdictions to meet these goals. The County of San Mateo is establishing several new programs and policies to meet the mandates, including an edible food recovery (EFR) program to redistribute surplus edible food to people in need.

 

On January 5, 2021 this Board approved a contract with Samaritan House which established an agreement for $978,952 for the term of January 5, 2021 through June 30, 2023 (Resolution No. 077919) to recover surplus edible food from supermarkets and wholesalers and to redistribute this surplus food to county community members in need. This is part of an EFR program pilot with non-profits and core service agencies in the county.

 

On December 7, 2021, this Board adopted Ordinance No. 4857, establishing an EFR program that requires local food generators to contract with food recovery organizations to collect and distribute their surplus edible food. This has allowed the Office of Sustainability (OOS) to transition the successful EFR program pilots, including the collaboration with Samaritan House, to a large-scale countywide EFR program in partnership with all the cities, towns, and solid waste special districts in the county. Since the launch of the pilots, the EFR program has supported the recovery and distribution of over 17 million pounds of edible food to residents throughout the county with over 15 percent of this work being conducted by Samaritan House. This supplied important supplemental food to communities during the COVID-19 pandemic while simultaneously supporting the County’s ongoing compliance with SB 1383.

 

DISCUSSION:

The original agreement for EFR services with Samaritan House is for a not-to-exceed amount of $978,952, for services provided January 5, 2021 through June 30, 2023.

The need for this EFR program continues and $326,337 of the original funding for this agreement remains unspent and available. As such, both parties currently desire to reinstate and amend the agreement to extend the term to provide EFR program services within the original budget amount.

 

The OOS seeks approval from this Board to execute an agreement to reinstate the agreement with Samaritan House and rescind its termination so that the agreement shall be in full force and effect as if never terminated and extend the term of the agreement through June 30, 2025. This will allow the continuation of Samaritan House’s vital services in the recovery and distribution of surplus edible food around the county.

 

The County Attorney’s Office has reviewed and approved the resolution and Reinstatement and First Amendment to the Agreement as to form.

 

FISCAL IMPACT:

This reinstatement will extend the term of the agreement to June 30, 2025. The total not to exceed value of the agreement will stay unchanged. This agreement will be funded by monies from the AB 939 Fund Account and costs are included in the FY 2023-24 Adopted Budget and will be included in the preliminary 2024-25 Recommended Budget. The AB 939 Fund Account is funded by fees levied on all waste disposed of at the Ox Mountain Landfill and is specifically designated for waste reduction and diversion programs across the county. There is no Net County Cost.
