Acting as the Governing Board of County Service Area No. 8, adopt a resolution setting Tuesday, June 9, 2026, at 9:15 a.m. at the regularly scheduled Board of Supervisors meeting as the time and place for a public hearing on the filing of the Garbage and Recyclables Collection Service Charges Report for County Service Area No. 8 (CSA-8, North Fair Oaks) for fiscal year 2026-27.

BACKGROUND:
On October 20, 2009, this Board adopted Resolution No. 070423, which approved a franchise agreement with Recology San Mateo County (Recology) to provide services for the collection of recyclable materials, organic materials, and garbage from January 1, 2011, through December 31, 2020. On June 4, 2019, this Board adopted Resolution No. 076641, approving the amended and restated Recology Franchise Agreement for an additional 15-year term expiring on December 31, 2035.
On January 14, 2025, this Board adopted Resolution No. 080851, setting the garbage and collection rates for County Service Area No. 8 (CSA-8) effective January 1, 2025. However, the rates for those properties that pay for garbage and collection services via the County tax roll took effect July 1, 2025. There is no increase in garbage and collection rates for calendar year 2026. The 2025 CSA-8 Adopted Collection Rates are attached as Exhibit A.
DISCUSSION:
The County pays Recology for residential dwelling garbage services in CSA-8 by collecting fees from property owners, based on the required minimum residential garbage service levels for the property, as outlined in County Ordinance Code 4.04.220. These fees are defined and adopted each fiscal year in the Collection Service Charges Report (Charges Report) and placed on the subsequent County tax roll. The adoption of the 2026-27 Charges Report allows the fees to be placed on the FY2026-27 tax roll. As per County Ordinance Code, customers receiving additional services above the minimum garbage service levels pursuant to the franchise agreement are billed by Recology directly.
The County Ordinance Code requires this Board to hold a public hearing to consider public testimony prior to adopting the Charges Report. The recommended action - adopting a resolution setting the time and place for the public hearing - is the first step in the process and is procedural.
On the date of the public hearing, June 9, 2026, the data for the relevant tax rate area to be utilized in development of the Charges Report will not yet be finalized by the County; therefore, the Charges Report may be revised to reflect any parcel updates received from the County Assessor and/or County Controller on or after June 9, 2026.
Adoption of the Charges Report for FY 2026-27 and its filing with the Clerk of the Board will result in the user charges contained therein being placed on the County tax roll for CSA-8. These charges will appear on the FY 2026-27 tax bill of each affected property and will be collected in the same manner as property taxes. The rates adopted by this Board on January 14, 2025, will be used to perform the calculation for the FY 2026-27 residential and multi-family dwelling charges that will appear on the property owner’s FY 2026-27 tax bill.
The remaining county franchised areas (CFA) covered by the franchise agreement are billed directly by Recology and the garbage and recyclables collection service charges for those areas are not placed on the tax bill.
The County Attorney’s Office has reviewed and approved the resolution as to form.
COMMUNITY IMPACT:
To ensure that property owners subject to the Collection Charges Report process are informed of the June 9 public hearing, as per County Ordinance Code Section 4.04.260, the County will publish information including the time and place of the hearing once a week for two successive weeks prior to the hearing in a newspaper of general circulation in County Service Area No. 8. The Draft Notice for Setting Collection Charges Report is attached as Exhibit B. The County will also share information directly with the North Fair Oaks Community Council and through digital channels, to help inform residents in the North Fair Oaks area.
FISCAL IMPACT:
There is no fiscal impact associated with the recommended action of setting a public hearing as there is no increase in garbage and collection rates for calendar year 2026.
Staff time involved in preparing the Charges Report for CSA-8, administrative documents, and public advertisement of the hearing is part of the administrative cost associated with managing the garbage collection and recycling services in CSA-8 and is paid for with franchise fees.
