Adopt a resolution:
A) Waiving the Request for Proposals process; and
B) Authorizing the President of the Board to execute an agreement with The Gordian Group for the maintenance and support of eGordian, the Job Order Contracting System and Job Order Contracting Program for the term of August 8, 2020 through August 7, 2023, in an amount not-to-exceed $500,000; and
C) Authorizing the Director of Public Works, or his/her designee, to execute subsequent amendments, task orders, or make administrative changes not to exceed an aggregate amount of $25,000.

BACKGROUND:
Job Order Contracting (JOC) is a task-based method of project delivery whereby contractors (e.g. general, mechanical, electrical, utilities or road contractors) agree to perform various construction tasks for a set fee. JOC has been extensively utilized at the federal, state, and local government levels for over 26 years.
On August 8, 2017, this Board approved Resolution No. 075396, which authorized an agreement with The Gordian Group to develop, implement, and support the JOC system for the Department of Public Works (Department).
The Department has made increasing and substantial use of this contracting system since its implementation in 2008 and over $60 million in projects have been completed under the program since its inception.
The Department is currently using The Gordian Group’s proprietary software system, eGordian, to track and manage 19 JOCs, (five for general construction, two for mechanical works, two for roofing, two for flooring, two for plumbing, one for electrical & lighting, two for painting, and three for engineering). The eGordian system has been customized to fit the County’s JOC needs. The current JOC contracts will expire in January 2021.
DISCUSSION:
eGordian allows the Department the option of selecting the JOC Complete Solution and JOC Complete Solution Plus level of services on a project-by-project basis under the recommended contract. The additional Complete and Plus level services include Job Order development, estimating and construction management services. This will facilitate completion of JOC projects and expedite project delivery.
The Department is requesting a waiver of the Request for Proposals process because The Gordian Group remains the sole source provider of products and services for the JOC program. A listing of agencies that have recently conducted RFPs and awarded The Gordian Group sole source contracts is attached as “Attachment A.” The dollar value of this agreement is consistent with those agreements set forth as a result of the aforementioned RFP’s and sole source justification.
The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination, and equal benefits.
County Counsel has reviewed and approved the Resolution and Agreement as to form.
FISCAL IMPACT:
Funding has been included in the Capital Improvement Program project budgets that will be delivered using JOC. The term of this agreement is from August 8, 2020 through August 7, 2023 for a not-to-exceed amount of $500,000.
There is no additional impact to the General Fund.
