Adopt a resolution designating Maguire Correctional Facility (Maguire) as a facility designated by the County for evaluation and treatment under Welfare and Institutions Code section 5150 et seq. and simultaneously authorizing a Memorandum of Understanding detailing the 5150 process and procedures with the provider for the term November 13, 2018 through November 12, 2019.

BACKGROUND:
In the past, the County of San Mateo contracted with the County of Santa Clara for the use of acute psychiatric inpatient beds within their correctional facility to place and treat San Mateo County Jail inmates experiencing mental illness. However, the County of Santa Clara terminated the agreement in 2017.
On September 9, 2017, Correctional Health Services (CHS) released a request for proposals for acute psychiatric inpatient bed services within a correctional facility. Liberty Healthcare (Liberty) was selected as the provider for these services and has been working towards a County designation. A Designation Review Team (DRT), comprised of the Behavioral Health and Recovery Services (BHRS) Medical Director, BHRS Assistant Director, BHRS Quality Manager, BHRS Office of Consumer and Family Affairs Director, and the Office of Patient Rights Advocates, was established to work with CHS and Liberty to train staff and create policies in preparation for the designation. The DRT has been working with staff to establish the terms of the designation represented in the MOU, identifying training and certification requirements necessary to: comprehend County involuntary hold policies and write involuntary holds, develop competency in patient rights and hearing procedures, and recruit and hire required staff to operate the unit.
At a minimum, the Maguire Acute Stabilization Unit (ASU) expands the inpatient hospital service continuum in the County which will enable inmate patients to remain in County - close to family - and meet a growing need in the service continuum for level of care capacity. The ASU is ultimately expected to reduce the impact on San Mateo Medical Center, which has provided acute psychiatric care to County inmates in the interim. This arrangement has not been ideal, as it has required transporting inmates from the jail to the hospital where they were treated alongside the public.
DISCUSSION:
Through this MOU, San Mateo County BHRS Division requests your Board to designate the Maguire ASU as a 5150 facility. The designation allows Maguire / Liberty the authority to receive patients on a 5150 hold and provide psychiatric evaluation and treatment, and meet the admissions criteria as determined by Liberty. This designation conforms to the requirements of BHRS Policy 90-09: 5150 Designated Facilities, California Welfare & Institutions Code Section 5150. Et seq., and California Code of Regulations Title 9, Section 821, et seq.
The DRT determined that Maguire Correctional Facility met the requirements to be designated as an ASU. The Team will annually review Maguires’ and Liberty’s performance as a designated 5150 facility, making recommendations for improvement if needed prior to the expiration of the MOU.
The agreement and Resolution have been reviewed and approved by County Counsel as to form.
Approval of this agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by providing 5150 services to County inmates, which in turn contributes to the health and safety of communities throughout the County. It is anticipated that 75% of the ASU inmates will receive care and treatment that specifically addresses their presenting condition in an environment dedicated to this population.

FISCAL IMPACT:
The term of the agreement is November 13, 2018 through November 12, 2019. There is no funding associated with this agreement.
