Subject: Amendment to Job Order Contract 2601 Agreement with SBay Construction, Inc.

Adopt a resolution authorizing:
A) An amendment to the agreement with SBay Construction, Inc., increasing the amount payable by $210,000 for a new not-to-exceed amount of $6,210,000 without change in term; and
B) The Director of Public Works, or the Director’s designee, to issue Work/Job Orders, execute Change/Revision Orders, and make financial and administrative changes to the executed Job Order Contract agreement.

BACKGROUND:
On November 19, 2013, the Board adopted Resolution No. 072896, establishing the County’s streamlined Job Order Contracting (JOC).
Subsequently, on January 27, 2026, the Board adopted Resolution No. 081623(a), awarding the JOC Agreement to SBay Construction, Inc. to provide general construction services for repair, remodeling, or other repetitive work to be completed on County-maintained facilities.
DISCUSSION:
The Department of Public Works (Department) has been tasked with repairing and renovating various County-owned facilities for tenant improvements. This work has been deemed a priority in the County’s effort to vacate leased spaces. SBay Construction, Inc. is currently mobilized and performing work across multiple project sites. Increasing the contract capacity ensures project continuity, operational efficiency, and timely delivery of facility renovations, allowing the County to occupy these spaces as scheduled.
This amendment to the agreement with SBay Construction, Inc. increases the not-to-exceed amount by an additional $210,000 to complete the work necessary for repair, remodeling, and other repetitive work in County-owned facilities. All other terms of the JOC Agreement remain in full force and effect.
The County Attorney has reviewed and approved the resolution and amendment as to form.
COMMUNITY IMPACT:
Increasing a contractor's not-to-exceed limit impacts the community by preventing costly project work stoppages, ensuring critical public infrastructure is completed on time, and allowing local small or minority-owned subcontractors to receive steady, uninterrupted payments during construction.
FISCAL IMPACT:
The amendment to this agreement increases the current amount by $210,000, for a new not-to-exceed maximum fiscal obligation of $6,210,000. The various individual job orders will be funded through previously approved and appropriated projects within the FY 2026-27 Adopted Budget.
There is no additional impact to the General Fund.
