B)                     The President of the Board to execute an agreement with Jensen Landscape Contractor, LLC, in the amount of $8,949,000 for the Realize Flood Park Project - Phase One; and

 

C)                     The Director of Public Works to:

 

1.                     Execute subsequent change orders to grant time extensions for project completion and payment up to a maximum aggregate amount not to exceed $894,900 or approximately 10 percent of the agreement amount; and

 

2.                     Execute payment up to the not to exceed amount of $9,843,900 for items requiring adjustment based on unit bid prices without execution of a change order.

BACKGROUND:

Flood County Park (“Flood Park”) is a 21-acre County-owned and operated park that is located in the City of Menlo Park. Founded in 1937, Flood Park has served the recreational needs of residents of southern San Mateo County for over 85 years. Although Flood Park was a thriving public resource for much of its existence, in recent decades, park facilities have deteriorated. Today, Flood Park consists of a playground, sand volleyball courts, baseball and softball fields (unusable due to poor condition), picnic/reservation sites, tennis courts (unusable due to poor condition), and open grassy fields with mature trees. The Park serves as a major recreation resource for many residents of Menlo Park, North Fair Oaks, and East Palo Alto.

 

In 2014, the San Mateo County Parks Department (“Department”) assessed the condition of Flood Park’s amenities and determined that a complete overhaul was warranted. This led to the creation of the Realize Flood Park Project (“Project”), a multi-year public engagement process that led to the development of the landscape plan and Final Revised Environmental Impact Report (“EIR”).

 

On November 10, 2020 this Board of Supervisors adopted Resolution No. 077827, which: 1) approved the 2020 Flood County Park Landscape Plan; and 2) certified the Flood County Park Landscape Plan’s Final Revised EIR and Errata; and 3) adopted the California Environmental Quality Act Findings of Facts and a Statement of Overriding Consideration; and 4) adopted the Mitigation Monitoring and Reporting Plan. On July 26, 2022 this Board adopted revisions to the 2020 Flood County Park Landscape Plan by way of Resolution No. 079047 and directed the Department to prepare project design plans based on the Final Revised Landscape Plan.

 

On July 20, 2021 this Board adopted Resolution No. 078335, which authorized an Agreement with CMG Landscape Architecture (“CMG”) for the professional services required to design and permit the Project, and for an amount not to exceed $1,892,710.

 

On December 13, 2022 this Board adopted Resolution No. 079396, which authorized the finalization of the Project plans and specifications, including conformance with prevailing wage scale requirements and call for sealed bids for the Project.

 

On September 12, 2023 this Board adopted Resolution No. 079918, which rejected all bids received for the Project and authorized the Director of Public Works to readvertise for bids on the Project.

 

DISCUSSION:

Based on a cost analysis, available funding, and permitting requirements, it was determined that the Project will be implemented in multiple phases. Phase One includes construction of the small multi-use sport field, tennis/pickleball courts, sand volleyball courts, a basketball court, picnic and reservation areas, walking paths, utility infrastructure, and the northern parking lot.

 

On Thursday, February 1, 2024 bids were accepted for the Project and subsequently referred to Public Works for checking and recommendation. The bid of:

 

Jensen Landscape Contractor, LLC

Milpitas, CA 95035

 

at $8,949,000 was the lowest responsible bid received for the work for the total base bid.  The Engineer’s Estimate was $11,500,000. A summary of the bids received is attached as Exhibit “A”.

 

Pursuant to the proposed agreement, the Contractor will mobilize no later than April 8, 2024. During construction of the Project, the new Flood Park Pump Track will remain open to the public. All other areas of the Park will be closed due to construction activities. While the Department intended to keep the playground open during construction, in October 2023, it was determined that the current playground at Flood Park does not meet California playground safety standards. Because of the playground’s age, the manufacturer no longer produces replacement parts making the playground obsolete and unsafe to use. 

 

County Attorney has reviewed and approved the resolution as to form.

 

FISCAL IMPACT:

The estimated cost for construction is $9,843,900 which includes authorization for up to $894,900 in change orders as the work is bid on a unit price basis. The contingency is used to pay the contractor for any unforeseen conditions not anticipated in the construction agreement documents. Sufficient funds are included in the Parks Department’s FY 2023-24 Adopted Budget and will be included in the Department’s FY 2024-25 budget for this Project.

 

Funds in the Capital Projects Budget have been allocated for this Project.
