Subject: Amendment to the Agreement with Bamboo Health, Inc to Expand Prescription Monitoring Program Gateway and Submission Services to Additional Divisions Within San Mateo County Health and Extend the Agreement Term
RECOMMENDATION:
title
Adopt a resolution authorizing a first amendment to the agreement with Bamboo Health, Inc., to extend the term by an additional three years for the term of April 23, 2024 through April 22, 2032, and increase the County’s maximum fiscal liability by $478,029 for an amount not to exceed $840,683.
body
BACKGROUND:
On December 13, 2022, the Board approved an agreement with Epic Systems Corporation (Epic) to provide the Electronic Health Record (EHR) system for San Mateo County Health (SMCH). The Prescription Monitoring Program Gateway and Submission Services software and service were previously embedded in the existing EHR solution, which expired with the go-live of the new EHR.
In April 2024, the Board approved an agreement with Bamboo Health Inc (Bamboo) to provide Prescription Monitoring Program Gateway and Submission Services within the new EHR for a term of April 23, 2024 through April 22, 2029 in an amount not to exceed $362,354 (Agreement). This approval was granted without competitive procurement because Bamboo was the only approved vendor awarded the contract for data collection and submission under Health & Safety Code section 11165(d) by the State of California, fulfilling the State’s Controlled Substance Utilization Review and Evaluation System (CURES) requirement. In order to maintain compliance with the State of California’s Prescription Drug Monitoring Program requirements, SMCH needed to utilize a vendor also approved by the State to execute this function. In addition to meeting this requirement, Bamboo also had proven software and relevant experience.
DISCUSSION:
In April 2027, SMCH will expand the EHR to Behavioral Health and Recovery Services (BHRS). Bamboo services are required to maintain compliance with CURES. To support this expansion, SMCH is adjusting the original Bamboo provider account to add user licenses. Since SMCH executed its original contract in April 2024, the State has not expanded its contract for data collection and submission to fulfill the CURES requirement to any other entity, and Bamboo remains the State’s sole vendor capable of executing this vital function. Staff recommends amending the Agreement to extend the term through April 22, 2032 and increase the not to exceed amount by $478,029 to $840,683.
The amendment and resolution have been reviewed and approved by the County Attorney as to form.
County Procurement has approved a waiver request to extend the Agreement to eight years.
The Technology Services Department has reviewed and approved the IT component of this Agreement.
The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).
It is anticipated that the County will maintain a 100% rate of compliance with CURES submission requirements.

Community Impact:
San Mateo County residents who receive prescriptions for controlled substances benefit directly from the County's continued participation in the State's Prescription Drug Monitoring Program. By maintaining uninterrupted integration with CURES made possible through Bamboo, SMCH clinicians are equipped to identify patterns of over-prescribing, potential misuse, and unsafe combinations of controlled substances before harm occurs, supporting safer care for some of the County's most vulnerable patients.
Extending this agreement through Phase II of the Epic rollout ensures that BHRS, Aging and Disability Services, and other County Health divisions coming online will have full CURES submission capability from the outset of their go-live. This continuity of coverage means more County residents, across more care settings, will receive the benefit of evidence-informed prescribing practices that help reduce the risks associated with controlled substance use in our community.
FISCAL IMPACT:
The term of the amended Agreement is April 23, 2024 through April 22, 2032. The amended Agreement amount is increased by $478,029, for an amount not to exceed $840,683 for the eight-year term.
This Agreement is entirely funded as part of the EHR budget unit, which is covered by proportional contributions from all County Health divisions. This may include some Net County Cost, depending on the composition of each division’s contribution.
