Adopt a resolution authorizing Amendment No. 1 to the agreement with Lotus Water to provide on-call flood control, drainage system study, environmental protection, stormwater management, and design services for various County projects, extending the agreement term through November 13, 2028, and increasing the amount by $500,000 to an amount not to exceed $1,500,000.

BACKGROUND:
On November 14, 2023, this Board adopted Resolution No. 080039(i), which authorized an on-call agreement with Lotus Water to provide flood control, drainage system study, environmental protection, stormwater management, and design services in an amount not-to-exceed $1,000,000 and for a period of three (3) years through November 13, 2026.
DISCUSSION:
Amendment No. 1 increases the not-to-exceed amount of the Agreement to $1,500,000. Lotus Water has performed on-call services for the Entrada Way Slip-out Project (Project), as well as other various County projects through Task Orders issued by the Department of Public Works (Department). Additional outreach efforts, complex design and permitting issues related to the Project require additional efforts from Lotus Water to analyze and complete the final design. The Department recommends Amendment No. 1 be executed to provide continued design services for the Project and other various County on-call projects.
The Department has coordinated with Lotus Water regarding the requested increase and time extension and is recommending that Amendment No.1 be executed to allow for continued needed services. Amendment No. 1 increases the not-to-exceed amount of the Agreement by $500,000 and extends the term through November 13, 2028.
The County Attorney has reviewed and approved the resolution and amendment as to form.
COMMUNITY IMPACT:
The Department, through this recommended action, reaffirms its commitment to complete improvements that serve our communities and ensures that critical design and construction activities can be accomplished. By completing the Project, the County will be preserving access to the La Honda community for both residents and emergency services, thus improving public safety and emergency preparedness.
FISCAL IMPACT:
This Amendment will increase the current Agreement amount by $500,000, for a new not-to-exceed amount of $1,500,000. Sufficient funds have been allocated in the Road Fund for this Amendment and the Department will seek Federal Emergency Management Agency (FEMA) funds for FEMA eligible emergency repair work.
There is no impact to the General Fund.
