BACKGROUND:

Aging and Adult Services (AAS) provides a wide range of services to assist seniors, people with disabilities, and dependent adults to live as safely and independently as possible in the community.

 

Adult Protective Services (APS), Elder and Dependent Adult Protection Team (EDAPT), and Probate Investigation (PI) in Aging and Adult Services assist adults (60 years and older) and dependent adults (18-59 years old with disabilities) when these individuals are unable to take care of their own needs, or are victims of abuse, neglect, or exploitation.

 

Some APS/EDAPT and PI clients need neuropsychological evaluations to determine whether they have the capacity to make decisions related to activities of daily living and instrumental activities of daily living, creating a will or trust, managing their own finances, or making medical decisions. The evaluations can be used in a petition for probate conservatorship or in an APS/EDAPT criminal trial. Further, the capacity assessments can help APS/ EDAPT and PI staff determine the level of intervention and support needed to protect clients from abuse or self-neglect while maximizing their right to self-determination in the least restrictive setting.

 

DISCUSSION:

AAS issued a Request for Proposals for capacity evaluation services in July 2024 and two proposers, Todd Finnemore PsyD and Bay Area Psychological and Forensic Services, Inc., were selected. Todd Finnemore PsyD has been providing services to the County since July 2022. Bay Area Psychological and Forensic Services, Inc. is a new contractor. Both contractors have years of relevant experience in the field and are well qualified to serve the needs of APS/EDAPT/PI clients.

 

The agreements and resolution have been reviewed and approved by the County Attorney as to form. 

 

The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).

 

It is anticipated that approximately 22 clients from APS/EDAPT and PI will receive capacity evaluation services every year.

EQUITY IMPACT:

A neuropsychological assessment is usually done by a clinical professional with experience in evaluating a person’s capacity to make decisions through psychological testing. This contract will positively impact the most vulnerable older and dependent adult population who is receiving services in three major programs at AAS: Probate Investigation, APS, and EDAPT. On average, APS/EDAPT and PI serves 13% Asian/Pacific Islander, 4% Black, 40% White, and 11% Hispanic clients. The contractors are expected to deliver culturally and linguistically congruent services by using a professional interpretation service during the evaluation should one be needed. Further, regardless of insurance or the ability to pay, an older or dependent adult who is receiving services from APS/ EDAPT or PI will be able to receive a neuropsychological evaluation if one is warranted. 

 

FISCAL IMPACT:

The term of the agreements with Todd Finnemore PsyD and Bay Area Psychological and Forensic Services, Inc. is November 1, 2024, through October 31, 2027, and the amount of each agreement is not to exceed $200,000 for the three-year term. The funding will come from APS General Funds. Funds for these services have been included in AAS FY 2024-25 Adopted Budget.
