body
BACKGROUND:
On March 4, 2025, the Chief Elections Officer administered the Special Election (“Election”). The official canvass and an abstract or Statement of the Vote for the Election were completed and certified by the Chief Elections Officer and are now available at the Registration & Elections Division (40 Tower Road, San Mateo). An electronic copy of the Statement of the Vote is also published on the Registration & Elections Division website, www.smcacre.gov, and a copy has been submitted to the Board, as required by state law.
DISCUSSION:
Under California law, the Chief Elections Officer, within 30 days of an election, is required to inspect, process, and count all ballots cast during an election and prepare a certified statement of the results.
Upon acceptance of this Certification of the Election, Elections Code Section 15400 directs the Board of Supervisors, as the governing body of the jurisdiction, to declare the results of each election under its jurisdiction as to each measure voted on at the election.
On March 4, 2025, the Election was conducted within the County of San Mateo, and the Board will be accepting the certificate of the Chief Elections Officer as the statement of the results of the vote for the Election.
It is recommended that the Board accept the certificate of the Chief Elections Officer as the statement of the results of the vote as determined by the official canvass of the Election.
Because the Election involved an amendment to the San Mateo County Charter, once the results of the Election are declared by the Board, two copies of the complete text of the amendment must be certified and authenticated by the Board President and Clerk of the Board and attested by the Chief Elections Officer, setting forth submission of the amendment to the electors of San Mateo County and its approval by them. One copy of the certified, authenticated, and attested amendment is to be recorded by the Clerk of the Board with the County Recorder and then filed in the Office of the Registration and Elections Division. The second copy shall be filed by the Chief Elections Officer with the Secretary of State in compliance with applicable provisions of the Government Code.
The County Attorney has reviewed and approved the Resolution as to form.
