BACKGROUND:

In 2021, on behalf of the County of San Mateo, San Mateo Medical Center (SMMC) engaged LCPH to provide “expert consultation services” at the Keller Center for Family Violence.  These services consisted of child abuse pediatricians providing care to abused minors, providing forensic evaluation services to the County to aid court proceedings, and acting as a liaison among SMMC medical and nursing professionals so that best practices in treating and evaluating child abuse may be followed.  The original “not to exceed” amount in the first iteration of the contract in 2021 was $ 110,000, which permitted SMMC to negotiate and sign the agreement at the agency level under County Administrative Memorandum B-1.  In July, 2022 that contract was renewed with an expansion of the scope of services and the addition of on-call consultation services by first amendment dated February 2023 all in an amount not to exceed $ 189,332, still less than the $ 200,000 fiscal threshold required for Board of Supervisors approval under County Administrative Memorandum B-1.  On July 1, 2023 - following Board of Supervisors review and approval - the County and LPCH agreed to extend the agreement without any additional change for one month and added $25,000 to the “not to exceed amount” (NTE), raising the amount to $ 214,332.  The County and LPCH are conducting negotiations to continue the pediatric child abuse consultation services and, at LPCH’s request, desire to extend the current agreement by one month such that the current amended agreement would expire September 30, 2023.  Since the requested extension would result in an additional two months of payments under the contract, approval is also being sought to increase the “not to exceed” amount by $50,000 to a limit of $ 264,332.

 

DISCUSSION:

There is no change in the level or cost of services being provided by LPCH to the County to cover child abuse pediatrics at the Keller Center for Family Violence.  LPCH requested a two month courtesy extension so that it could have more time to review a potential renewed agreement, which is causing an increase in the length of the agreement and therefore the “not to exceed amount” as the services continue to be provided over the extended term.

 

County Attorney has reviewed and approved the resolution and agreement as to form.

 

The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).

 

It is anticipated that LPCH physicians will be up to date regarding training for Keller Center examinations and protocols based on standards developed by the American Academy of Pediatrics and the American Professional Society on the Abuse of Children.

FISCAL IMPACT:

The term of the agreement is July 1, 2022  through September 30, 2023. The amount of the agreement is not to exceed $ 264,332  for the one-year and one-month term. Funds in the amount of $ 264,332 are included in the SMMC FY 2022-2023, and 2023-2024 Adopted Budget(s).

 

Expenses at SMMC are covered by fees for services or third-party payors whenever possible. The portion of expenses for services provided to the medically indigent or to those covered by programs that do not meet the full costs of care is covered by the County’s General Fund contribution to SMMC and is within the existing annual appropriation.
