BACKGROUND:

The state-mandated Municipal Regional Stormwater National Pollution Discharge Elimination System (NPDES) program protects and enhances water quality by reducing pollutants and eliminating non-stormwater discharges such as fluids, debris and waste into county storm drain systems, watercourses and waterbodies, including creeks, the San Francisco Bay, and the ocean. The County is subject to a NPDES state program and must comply with the permit issued by the San Francisco Bay Regional Water Quality Control Board (Water Board). In addition to NPDES permit requirements, the County is mandated by the Water Board to monitor and improve water quality in five watersheds: Pillar Point Harbor and Venice Beach, Pescadero-Butano, San Gregorio, San Vicente Creek, and San Pedro Creek and Pacifica State Beach.

 

In 2002, San Vicente Creek in San Mateo County was listed on the Federal Clean Water Act 303(d) List of Impaired Water Bodies and in May 2016 the Water Quality Improvement Plan (WQIP) policy became effective.

 

On June 27, 2017, this Board adopted a resolution to enter into an agreement with the San Mateo County Resource Conservation District (RCD) for a term of July 1, 2017, to August 30, 2022, in an amount not to exceed $385,243 to implement services related to water quality improvement and natural resource protection.

 

On July 1, 2022, the Sustainability Department entered into an agreement with the RCD to continue water quality monitoring, analysis and reporting services in San Vicente Creek, for the term of July 1, 2022, to June 30, 2025, in an amount not to exceed $117,248.

 

On May 30, 2025, the Sustainability Department extended the contract term by one year to June 30, 2026, and increased the contract amount by $67,285 to an amount not to exceed $184,533.

 

DISCUSSION:

The goal of the WQIP is to achieve safe water quality standards. To achieve this, the County must sample the creek, identify sources of pollution, and take action to reduce pollution in San Vicente Creek. The Department and RCD wish to amend the agreement by increasing the amount by $77,349 and extending the contract term by one year to June 30, 2027. This amendment will allow uninterrupted progress on ongoing water quality monitoring and reporting efforts.

 

Since the County began sampling San Vicente Creek in 2017, the water quality has seen measurable improvement. Over the course of this contract partnership, RCD has developed historical field knowledge, data sets, and site-specific expertise in bacteria source identification that continues to inform and strengthen the County's water quality monitoring program. Continuing this work through the RCD will allow for further analysis of seasonal patterns and bacterial concentrations, supporting the County's ongoing efforts to evaluate progress toward long-term regulatory and management objectives.

 

In accordance with County procurement policy, the Procurement Director or designee has recommended that the Board of Supervisors approve the waiver of the competitive process for this agreement because continuing services with the existing contractor is necessary to maintain continuity in the County’s multijurisdictional Water Quality Improvement Program efforts and support consistent monitoring and regulatory compliance.

 

The County Attorney’s Office has reviewed and approved the resolution and agreement as to form.

COMMUNITY IMPACT:

Stormwater pollution prevention is critical in reducing pollutants of concern and protecting water quality for all County residents.

 

FISCAL IMPACT:

The amendment to the agreement will increase the agreement amount by $77,349 for a new not to exceed amount of $261,882 and will extend the term to June 30, 2027. These funds are included in the FY 2026-27 Recommended Level Budget. There is no new Net County Cost associated with this amendment.
