BACKGROUND:

On October 30, 2007, this Board adopted Resolution No. 069071 addressing a significant landslide that occurred in the vicinity of Scenic Drive in La Honda. Among other actions to mitigate impacts from land movement in the area, this resolution appropriated $250,000 for the construction of improvements on the privately maintained portion of Escondido Drive.

 

On April 22, 2008, this Board adopted Resolution No. 069359 which established the La Honda Landslide Assessment District. Significant construction work was conducted to carry out the assessment district’s obligations and that work is complete.

 

Cuesta La Honda Guild (“Guild”) was incorporated in 1936 to provide water, recreational facilities, and roads to its members, as part of a common interest development of almost 300 homes. The Guild is also the fee owner of two properties, identified as APNs 083-080-310 and 083-080-300, which underly the privately maintained portion of Escondido Drive.

 

The construction improvements on the privately maintained portion of Escondido Drive previously approved by the Board have not yet been completed.

 

DISCUSSION:

The Department recommends that the Board enter into an agreement with the Guild to carry out the improvements on the privately maintained portion of Escondido Drive for a term of June 23, 2026 through June 22, 2029 in an amount not to exceed $250,000, using the funds previously appropriated for such work (“Agreement”).   

 

The Agreement authorizes disbursement of the funds upon Agreement execution. It further requires that the Guild construct the improvements on the privately maintained portion of Escondido Drive within three (3) years or it must return the funds to the County. The Guild will be responsible for applying for and obtaining all required permits to carry out the work.

 

COMMUNITY IMPACT:

Approval of the Agreement supports general and emergency roadway access to properties in an area previously impacted by land movement. Land movement in the area disrupted community access to properties, and carrying out this obligation to improve the private portion of Escondido Drive will support current and future residents’ ability access their homes and properties.

 

FISCAL IMPACT:

The Agreement includes a maximum fiscal obligation of $250,000. If the improvements are not constructed during the 3-year term of the Agreement, the Guild will be required to return the funds to the County.

 

Funding from the General Fund was previously appropriated in Resolution No. 069071, so there is no additional impact to the General Fund as a result of this action.
