B) Approve an Appropriation Transfer Request (ATR) in the amount of $50,000 appropriating Measure K funds from Non-Departmental Services Reserves to Non-Departmental Services Miscellaneous Other Contributions to provide full payment for the work completed by San Mateo County Resource Conservation District.

BACKGROUND:
On January 12, 2023, following significant storms and flooding, the County entered into an agreement (No. 12310-F23-D059, “First Agreement”) with the San Mateo Resource Conservation District (“RCD”). The services under this First Agreement included oversight and coordination of flood mitigation and response services for Pescadero Creek in San Mateo County where a large logjam had developed. The services were intended to prevent further damage from flooding to public and private infrastructure and to aid in the recovery of ongoing damage from flooding, with a focus on public safety, protecting roadways for emergency access/egress, and protecting the emergency evacuation center at the Pescadero High School. This First Agreement had a fiscal limit amount of $200,000 and was for the term January 12, 2023 through June 30, 2023.
On January 23, 2023, work commenced under the First Agreement, during which time it was discovered that the logjam had more than doubled in size since the initial assessment and the County reaffirmed the site as an immediate and urgent priority for mitigation. Addressing the dramatic increase in the magnitude of the logjam required additional time and effort for removal and processing and increased engineering oversight to ensure the mitigation effort was conducted safely and effectively. RCD completed the mitigation work at the site on February 3, 2023, prior to the storms of March 2023.
DISCUSSION:
The First Agreement limited the County’s fiscal obligation to $200,000, but the full cost of the mitigation and response services exceeded this amount by $50,000, for a total cost of $250,000. Prior to exceeding the contracted not-to-exceed amount under the First Agreement and in view of the ongoing emergency, the Director of the Activated Emergency Operations Center for the County approved RCD to provide the additional mitigation and response services at a cost of an additional $50,000. The First Agreement has since expired.
RCD submitted an invoice for the full amount of $250,000 (Invoice No. 1-SF23) to the County, reflecting the cost of all mitigation and response services provided, to which the County has paid only $200,000 as authorized under the First Agreement. Staff has prepared a proposed second agreement (the “Second Agreement”) as necessary to provide full payment to RCD for the completed emergency mitigation work.
In order to provide funding for the Second Amendment, an appropriation transfer request (“ATR”) from Non-Departmental Services Reserves to Non-Departmental Services Miscellaneous Other Contributions is necessary to provide full payment for the work completed by San Mateo County Resource Conservation District.
The ATR presented to this Board has been approved by the County Executive and Controller or their authorized designees.
The County Attorney has reviewed the proposed Second Agreement and resolution as to form.
EQUITY STATEMENT:
RCD works closely with the County to preserve the natural environment and health and human safety of San Mateo County residents, especially in time of emergency. Their work in this instance provided protection to the vulnerable residents on the San Mateo County Coast.

FISCAL IMPACT:
Funding for the payment of this additional $50,000 under the Second Agreement is necessary to provide full payment for the completed mitigation work performed by RCD. Measure K Reserves funding for these services is included in the Non-Departmental Services FY 2024-25 Approved Budget.
