BACKGROUND:
On October 19, 2021, this Board adopted Resolution No. 078497(d), which authorized the Agreement with AECOM Technical Services (AECOM) to provide construction management services in the amount not-to-exceed $1,500,000.
DISCUSSION:
AECOM has been providing construction management services for the Middlefield Road Improvement Project (Project) through Task Orders issued by the Department of Public Works (Department). Amendment No. 1 increases the not-to-exceed amount of the Agreement to $2,200,000 to allow for the continued provision of these services. The Project continues to make considerable progress; however, it has been significantly delayed due to unanticipated underground conflicts encountered during construction and impacts of severe weather. Additionally, in April 2023 the Department modified some of Project contract bid items to a Time and Material (T&M) basis. This change has provided increased flexibility to adapt to the changing requirements and has allowed for faster resolution of conflicts but this approach inherently increases the required construction inspection and management services.
AECOM’s construction management services will continue to be required as the Department works towards Project completion, including resolving unforeseen conflicts, reviewing and negotiating change orders, reviewing and verifying work under T&M, and inspecting additional roadway paving and sidewalk replacement work. AECOM is required to provide additional construction management resources and staffing to inspect and manage construction work, which was not originally anticipated due to construction change order work, T&M work, and the duration of AECOM’s efforts have been substantially longer than originally envisioned.
This Amendment will allow AECOM to continue to provide construction management services, including the review and negotiation of the outstanding change orders and required Project closeout work.
The Department has diligently coordinated, engaged in negotiations, and made necessary adjustment to the staffing levels with AECOM regarding the requested increase, ensuring a fair and reasonable cost. As a result of these efforts, the Department recommends that Amendment No.1 be executed to allow for continued construction management and Project closeout services.
County Attorney has reviewed and approved the resolution and amendment as to form.
FISCAL IMPACT:
This Amendment will increase the current Agreement amount by $700,000, for a new not-to-exceed amount of $2,200,000.
There is no impact to the General Fund.
