BACKGROUND:

Tunitas Creek Beach County Park (“Park”) is a 58-acre County-owned and operated park located in unincorporated San Mateo County approximately eight miles south of the City of Half Moon Bay. Purchased in 2017 by the Peninsula Open Space Trust (“POST”) and transferred to the County in 2020, the Park will be the first recreational beach park in the County Parks system. In 2019, the San Mateo County Parks Department (“Parks Department”), along with POST and other project partners, began a robust public engagement process to determine the design of new amenities and facilities for the Park property.

 

On June 13, 2023, in Resolution No. 079664, the Board adopted the plans and specifications for the Tunitas Creek Beach Improvement Project (“Project”), authorized an agreement with Gordon N. Ball, Inc. for construction of the Project in an amount not to exceed $11,593,710, and authorized the Director of Public Works to execute contract change orders to grant time extensions for Project completion and payment up to $1,159,371 in aggregate, for a total maximum fiscal obligation of $12,753,081.

 

On May 6, 2025, in Resolution No. 081138, the Board increased the Director of Public Works’ authority to execute change orders to the construction agreement with Gordon N. Ball, Inc. for the Project by an additional $1,500,000 to a new total not-to-exceed amount of $14,253,081.

 

DISCUSSION:

Construction of the Project has been completed, and the Department is proceeding with Project close-out activities, including processing final contractor invoices, authorized change orders, and resolution of outstanding claims.

 

During construction, two landslides occurred on portions of the Park property, preventing the Parks Department from opening the Park to the public. The Department worked to utilize a Job Order Contractor to perform the necessary slide repair work, which has since been completed, and the associated repair costs are included in this amount.

 

The Parks Capital Project fund will reimburse the Capital Projects Program for eligible Project costs, including final construction costs, approved change orders, and slide repair work reflected in this appropriation.

 

The County Attorney has reviewed and approved the ATR as to form.

 

FISCAL IMPACT:

Approval of the ATR will recognize unanticipated revenue in the amount of $3,513,000 to the Capital Projects Program for the Project. The Parks Capital Project Fund has sufficient appropriations in the FY 2025-26 Adopted Budget to support the $3,513,000 transfer for the Project. Potential funding gaps related to the outstanding claim and final Project close-out costs are currently being evaluated, and the final funding need will be determined upon resolution of the claim and completion of Project close-out activities.

 

There is no impact to the General Fund at this time.
