Adopt a resolution authorizing a third amendment to the agreement with Motorola Solutions, Inc. to provide lifecycle sustainment and maintenance services for the County’s public safety communications system, extending the term through June 30, 2026, and increasing the agreement amount by $1,961,884.91, in an amount not to exceed $5,669,504.97.

BACKGROUND:
On December 3, 2019, the Board of Supervisors approved Resolution Number 077064 and the County entered into an Agreement with Motorola Solutions, Inc. to provide lifecycle sustainment and maintenance services for the public safety communications system used throughout the County for law enforcement and emergency services. This Agreement included the ability to extend the services for additional periods at a level cost throughout the entire lifecycle of the engagement.
On April 20, 2022, the parties executed the first amendment for a revised term of July 1, 2020, through June 30, 2022.
On July 26, 2022, the parties executed the second amendment for a revised term of July 1, 2020, through June 30, 2024 for an increased Agreement total not to exceed $3,707,620.06.
The Information Services Department (ISD) has conducted a thorough operational audit of services included in this Agreement and has determined that the most appropriate course of action would be to do an amendment to the Agreement with Motorola Solutions, Inc. which will continue seamless support of the County’s public safety communications system.
DISCUSSION:
ISD hereby requests waiving the Request for Proposal (RFP) process as the digital, radio, communications system cannot be supported by any other organization, nor does Motorola Solutions, Inc. offer such services through resellers. ISD is seeking approval from your Board to authorize an amendment to the Agreement with Motorola Solutions, Inc.
The County Attorney’s Office has reviewed and approved the amendment and resolution as to both form and content.
The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).
County Contract Compliance Committee has reviewed and approved the three (3) year waiver request allowing Motorola Solutions, Inc. to continue providing services beyond the County’s three (3) year contract term limit.
Approval of this amendment will contribute to the performance measure by cost effectively upgrading the County’s radio communications system.

FISCAL IMPACT:
The new term of this Agreement is from July 1, 2020, through June 30, 2026, for a new total not to exceed amount of $5,669,504.97. Funding for this Agreement is appropriated in ISD’s Fiscal Year 2024-25 Recommended Budget and will be included in future fiscal years.
