A)                     Authorizing execution of a Supplemental Agreement between the Town of Woodside and the Fair Oaks Sewer Maintenance District for the transfer of one sewer connection in the Redwood Creek Main Trunk - Glens Sewer Collection System Assessment District; and

 

B)                     Directing the Director of Public Works to transmit a copy of the resolution with the appropriate agencies.

BACKGROUND:

The Fair Oaks Sewer Maintenance District (District) entered into an agreement with the Town of Woodside (Town) on April 2, 1968 (Agreement) for the provision of sewage transmission and disposal of wastewater collected through the District facilities for properties within the corporate limits of the Town and within the Town’s Redwood Creek Main Trunk and Glens Sewer Collection System Assessment District (Assessment District). The subject property is within the Town and outside of the original boundary of the Assessment District.

 

The Agreement requires properties within the Town that are proposed to be served by the District be annexed to the District, and also requires the Town to approve said annexations into the District. The Agreement also provides that no parcel exterior to the boundary of the Assessment District shall be permitted to connect to the sewer system acquired or constructed by the Assessment District without first obtaining the approval of both the Town and the District. The Town executed Resolution No. 2025-7754 on June 10, 2025 (attached), granting a sewer service allocation in the Assessment District to be transferred, consenting to the proposed annexation of this property to the District, and executing the Supplemental Agreement to transfer a certain unused sewer connection from the Assessment District to the Lands of Boyle Family Trust.

 

The subject parcel is not within the Sphere of Influence (SOI) of the District and it is appropriate for the San Mateo Local Agency Formation Commission (LAFCo) to amend the SOI to include the territory in the SOI of the District. The owner submitted an application to LAFCo requesting a SOI amendment and annexation of 1210 Cañada Road to the District, pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code. A LAFCo public hearing was held to consider the proposed SOI amendment and annexation of 1210 Cañada Road to the District. At the regularly scheduled LAFCo hearing on November 19, 2025, LAFCo adopted Resolution No. 1344 for File No. 25-11 (attached), approving the SOI amendment and annexation, contingent upon the Town’s and this Board’s execution of the Supplemental Agreement.

 

DISCUSSION:

The Boyle Family Trust is the current owner of the property within the Town at 1210 Cañada Road, which is also identified as Assessor’s Parcel Number 072-130-440. The owner has requested that the property be annexed to the District in order to receive sewer service.

 

The District will be able to provide sewer service to the property upon execution of a Agreement to transfer one of the unused connections within the Assessment District to 1210 Cañada Road to maintain the integrity of the purchased sewage treatment capacity of the Assessment District. Therefore, the District is recommending that the Supplemental Agreement be executed.

 

The County Attorney has reviewed and approved the resolution and Supplemental Agreement as to form.

 

COMMUNITY IMPACT:

This Board authorizing the execution of the Supplemental Agreement will result in the District providing sewer service to a parcel in an area that would otherwise use an "on-site" method to handle wastewater, which could have an impact on the environment and neighboring residents.

 

FISCAL IMPACT:

The property owner has paid or will pay all required fees for the parcel to the District as follows:

The property owner will be subject to the annual sewer service charge levied by the District, which has been set for $1,135 for FY 2025-2026. The property owner will construct and pay for the sewer lateral that is necessary to bring sewer service to this property.

 

There is no impact to the General Fund.
