Adopt a resolution authorizing:
A) The President of the Board of Supervisors to execute an amendment to the agreement with Skidmore, Owens, & Merrill, LLP, (SOM) increasing the agreement amount by $658,615.70 for an adjusted contract sum of $12,303,041.20; and
B) The County Executive Officer, or designee, to execute subsequent architectural service requests that modify the terms and conditions of the agreement and increasing the contract value up to $50,000 for a not to exceed final agreement amount of $12,353,041.20.

BACKGROUND:
On June 23, 2020, this Board adopted Resolution No. 077488 authorizing an agreement with SOM for architectural services for County Office Building 3 (COB3).
Now completed, COB3 is notable as the nation's first mass timber civic building designed to achieve net-zero energy performance. The biophilic design, featuring an exposed mass timber structure, successfully reduced embodied carbon while enhancing the occupant and visitor experience. The building’s innovative features have established it as an influential and award-winning model for sustainable and practical civic architecture.
DISCUSSION:
The amendment authorizes payment for additional services rendered by SOM during the extended service period. The specific services include, inter alia: (1) extended construction administration overseeing construction to ensure consistency with design; (2) extended commissioning overseeing building system optimization to ensure performance consistent with design; and (3) owner-requested design modifications to interior layouts and landscaping to meet updated or newly identified operational and functional needs. SOM’s extended role has been vital in addressing these issues and requests as they arise, coordinating with the contractor, and guiding the project through its concluding phases.
The proposed amendment will increase the amount authorized to be paid under the agreement with SOM by $658,615.70, establishing a new not to exceed amount of $12,303,041.21. The adjustment reflects the additional services required due to the extended schedule and other related change orders necessary for project completion.
The County Attorney has reviewed and approved the amendment to the agreement and the accompanying resolution as to form, ensuring compliance with all legal requirements.
COMMUNITY IMPACT:
County Office Building 3 or COB3 is the County’s and the Board of Supervisors support to build sustainable infrastructure and a big step to improving the County’s carbon footprint. The County is proud to construct the first Civic Building in the Country that boasts CLT construction and Net-Zero energy design.
FISCAL IMPACT:
Funding for this agreement is within the Board approved County Office Building 3 capital project budget. The funding has been established in fiscal year 2025-2026 as non-departmental, general fund.
