B) The Chief of San Mateo County Health, or designee(s) to execute any agreements and amendments to agreements associated with the Proposition 36 implementation.
body
BACKGROUND:
Proposition 36 established new behavioral health requirements intended to expand access to treatment and supportive services for individuals involved in the criminal justice system who are experiencing substance use disorders and related behavioral health needs.
To support county implementation of these requirements, the California Department of Health Care Services (DHCS) entered into Standard Agreement #25-50425 with Sierra Health Foundation Center for Health Program Management (The Center) for the fiscal administration of Proposition 36 funds designated for counties.
San Mateo County Behavioral Health and Recovery Services (BHRS) has been awarded funding through a Subrecipient Agreement with The Center to support the County's implementation of Proposition 36 behavioral health requirements.
DISCUSSION:
The Subrecipient Agreement between The Center and the County provides a total award of $492,945.23 for the implementation of Proposition 36 behavioral health requirements. The funding will support BHRS activities necessary to implement and operationalize the behavioral health requirements associated with Proposition 36. These activities will enable the County to strengthen coordination between behavioral health and justice-system partners, facilitate access to appropriate assessment and treatment services, and develop the infrastructure and processes necessary to meet state implementation requirements.
The agreement provides for advance payment of the full award amount upon execution of the agreement and satisfaction of applicable insurance requirements. The County is required to use the funds in accordance with the approved scope of services, the Subrecipient Agreement, and applicable requirements contained in the DHCS Prime Contract.
BHRS will maintain appropriate fiscal and programmatic documentation and comply with applicable reporting, monitoring, audit, and record-retention requirements associated with the funding.
The resolution contains the County’s standard provision allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).
The agreement and resolution have been reviewed and approved by the County Attorney as to form.
It is anticipated that the County will develop and implement 100% of infrastructure, workflows, and partnerships to support Proposition 36 behavioral health requirements.

COMMUNITY IMPACT:
The Proposition 36 funding will support access to behavioral health services for individuals who may otherwise face barriers to timely assessment, treatment, and supportive services. Implementation of the required behavioral health processes will strengthen coordination among County behavioral health services, justice-system partners, and community-based providers and promote more consistent access to appropriate care.
FISCAL IMPACT:
The term of the grant and agreements is from March 1, 2026, through March 31, 2028. The amount of the agreement is not to exceed $492,945.23 for the two-year term.
