BACKGROUND:
In 2020-21, the Sheriff’s Office transitioned from the Smith & Wesson M&P pistol to the Sig Sauer P320 red dot platform as the standard issued duty firearm for all sworn staff members, as the M&P pistol had reached the end of its service life. Red dot equipped pistols were emerging as a law enforcement standard.
Nationwide reports emerged concerning the Sig Sauer P320’s safety and patterns of unintentional discharging while holstered. Despite initial assurances from the manufacturer that the weapon was safe and up to date with all recommended safety upgrades, numerous documented incidents and lawsuits across the country have proven otherwise. On August 30, 2024, an FBI investigative report was released confirming the P320’s potential to discharge without trigger manipulation while holstered.
Although the Sheriff’s Office has not experienced any discharges locally, the consistency and seriousness of external, nationwide incidents warrant immediate action. Agencies at both federal and local levels have taken and continue to take decisive steps to discontinue or ban the Sig Sauer P320 pistol.
DISCUSSION:
The Sheriff’s Office recommends the immediate emergency procurement of 425 Glock Model 45 Gen5 9mm handguns and compatible holsters to replace the current inventory of Sig Sauer P320s. Glock is currently carried by approximately 77% of California law enforcement agencies and is widely recognized for its reliability and safety with no reported issues. Glock is also carried by numerous law enforcement agencies and federal agencies.
LC Action Police Supply is the sole authorized distributor for Glock handguns through the Glock Blue Label Program, which offers discounted blue label pricing for law enforcement agencies, in California. There is currently a minimum 90-day waiting period for purchase delivery following order placement, with increasing risk of longer waiting times as more agencies switch from the Sig Sauer P320s to safer handguns such as the Glock Model 45.
Timely authorization of a sole-source emergency procurement with LC Action Police Supply will ensure the Sheriff’s Office protects its law enforcement personnel and the public and reduces risk of significant liability exposure to the department and County. Proactively transitioning to the Glock Model 45 mitigates this liability and affirms our commitment to officer safety and operational readiness.
In addition, competitive procurement requirements have been waived by the County Executive Officer or designee.
COMMUNITY IMPACT:
The Glock Model 45 is a proven, widely adopted and modern duty firearm with a strong record of reliable performance and enhanced safety features that reduce any risk of accidental discharge. Replacing the current inventory of Sig Sauer P320s with Glock handguns will mitigate the County’s potential legal exposure from equipment-related incidents, restore officer confidence in issued equipment, reduce the likelihood of injury to personnel or the public, and reinforce our commitment to responsible firearm management and community trust.
This transition to a safer, more dependable duty handgun reflects the Sheriff’s Office proactive leadership in addressing a known safety concern and its prioritization and commitment to operational readiness and safeguarding both our personnel and the communities they serve.
FISCAL IMPACT:
There is no Net County Cost in FY 2025-26 in the Sheriff’s Office Budget for this sole-source emergency procurement in an amount not to exceed $403,940.72, as it will be entirely funded by Net County Costs in Non-Departmental Services. This funding has been included in the proposed FY 2025-26 Adopted Budget.
