Adopt a resolution authorizing an agreement with Bamboo Health, Inc. for Prescription Monitoring Program gateway and submission services for the Electronic Health Record and Controlled Substance Utilization Review and Evaluation System requirements for the state of California for the term of April 23, 2024, through April 22, 2029, in an amount not to exceed $362,354.

BACKGROUND:
On December 13, 2022, this Board approved an agreement with Epic Systems Corporation (Epic) to provide the Electronic Health Record (EHR) system for San Mateo County Health (SMCH). The software and service were previously embedded within the existing EHR solution that will be expiring with the go-live of the new EPIC EHR solution.
DISCUSSION:
To ensure the successful implementation of SMCH’s new integrated EHR and maintain compliance in the State of California’s Prescription Drug Monitoring Program requirements, it is necessary to secure a vendor with the proven software, experience, and ability to submit Health Information Technology (HIT)’s data for the Controlled Substance Utilization Review and Evaluation System (CURES) requirement. CURES is a platform maintained by the California Department of Justice that tracks all Schedule II through Schedule V controlled substances dispensed to patients in California. Data submission requirements are exclusively managed by Bamboo Health, Inc., who is designated by the State of California as the “CURES Prescription Data Collection Vendor” responsible for providing assistance with data submission and transmission into the CURES system. The agreement would be exempt from competitive procurement requirements under County Administrative Memorandum B-1, Section IV-subsection C.1. with additional unique performance factors under subsection C.4.
The County Attorney’s Office has reviewed and approved the resolution and agreement as to form.
The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).
The Information Services Department has reviewed and approved the IT component of this agreement.
It is anticipated that with Bamboo Health’s services, the County will remain 100% compliant with the CURES submission requirements.

FISCAL IMPACT:
The term of this agreement is from April 23, 2024, through April 22, 2029. The amount of the agreement is not to exceed $362,354.00 for a five-year term.
Funds are included in County Health’s FY2023-24 Adopted Budget. Future costs will be covered by proportional contributions from all County Health divisions, which may include some Net County Cost, depending on the composition of each division’s contribution.
