BACKGROUND:

In April 2021, San Mateo Medical Center (SMMC) completed a Request for Proposals for medical waste disposal services. On December 14, 2021, SMMC and Clean Harbors Environmental Services, Inc. (Clean Harbors) entered into an agreement to provide medical waste disposal services for the term of January 1, 2022 through December 31, 2022, in an amount not to exceed $200,000. There have been several amendments extending the term of the agreement through February 28, 2025, and increasing the amount authorized to be expended to $625,000 with services covering SMMC, Correctional Health Services (CHS), Behavioral Health and Recovery Services (BHRS), and Public Health, Policy and Planning (PHPP).

 

DISCUSSION:

There is an ongoing need for medical waste disposal services at these County Health divisions. SMMC is requesting that the Board authorize an amendment to the agreement, as contemplated in the original RFP, to extend the term of the agreement by an additional 22 months through December 31, 2026, and increasing the corresponding amount of the agreement by $442,000, to an amount not to exceed $1,067,000. This amendment is coming to this Board late due to prolonged negotiations with the vendor.

 

Upon the end of this agreement, SMMC plans to either issue a Request for Proposals or purchase services from a participant of SMMC’s chosen Group Purchasing Organization vendor, Vizient.

 

County Attorney has reviewed and approved the resolution and amendment as to form.

 

The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).

 

The County’s Contract Compliance Committee has approved a waiver request for a five-year term for this agreement.

It is anticipated that medical and pharmaceutical waste generated by Health Services will be disposed of in 100% compliance with the Resource Conservation and Recovery Act.

EQUITY IMPACT:

There is a critical need for County Health to continue to receive safe, efficient, and environmentally sustainable medical waste management. Clean Harbors continued medical waste disposal services will positively impact equitable health outcomes because delivery of medical waste disposal services at SMMC, a public safety net hospital, addresses community need. SMMC’s patients span a wide spectrum of races, ethnicities, gender, and gender-identities. Within the past 18 months the largest cohorts of specialty care patients at SMMC were female (53%), Hispanic or Latino (57%), and primarily Spanish speaking (54%).

 

FISCAL IMPACT:

The term of the amended agreement is January 1, 2022 through December 31, 2026. The amendment increases the amount payable under the agreement by $442,000 to an amount not to exceed $1,067,000 for the five-year term. Funds in the amount of $195,173 are included in the SMMC FY 2024-25 Adopted Budget. Funds in the amount of $4,160 are included in the CHS FY 2024-25 Adopted Budget. Funds in the amount of $10,400 are included in the BHRS FY 2024-25 Adopted Budget. Funds in the amount of $6,933 are included in the PHPP FY 2024-25 Adopted Budget. Similar arrangements will be made for future years.

 

Expenses at SMMC are covered by fees for services or third-party payors whenever possible. The portion of expenses for services provided to the medically indigent or to those covered by programs that do not meet the full costs of care is covered by the County’s General Fund contribution to SMMC and is within the existing annual appropriation.
