Recommendation to:
A) Adopt a resolution authorizing the Executive Director of the Office of Arts and Culture, or designee(s), to accept a donation of $10,500 from the Sam Francis Foundation to establish the Sam Francis Arts Fund; and
B) Approve an Appropriation Transfer Request (ATR) in the amount of $10,500 by transferring such amount to the Office of Arts and Culture.

BACKGROUND:
Sam Francis was a contemporary artist who grew up in San Mateo and began painting in 1944 after being diagnosed with spinal tuberculosis resulting from a United States Air Corps accident.
The Sam Francis Foundation (“Foundation”) was created after the artist’s death to research, document, protect and perpetuate his creative legacy and is dedicated to the transformative power of art as a force for change, with a mission of furthering a greater understanding of Sam Francis’s art and ideas through a broad array of programs and activities designed to educate, inform, and catalyze new thinking about the importance of creativity in society.
DISCUSSION:
The Foundation wishes to donate $10,500 to establish the Sam Francis Arts Fund for annual scholarships or donations to youth arts education programming in San Mateo County.
The $10,500 donation would be governed by a Memorandum of Understanding between the County and the Foundation, a copy of which is included as Attachment A, which provides, inter alia, (1) that the $10,500 donation from the Foundation includes an administration fee of $500 (5 percent), (2) the County’s Office of Arts and Culture will disburse amounts each year, at its discretion from the remaining $10,000, scholarships or donations to be disbursed for youth arts programming in San Mateo County, (3) with a goal that the Sam Francis Art Fund will grow in perpetuity (depending on the rate of annual expenses and market growth) and encourage other individuals or organizations to contribute additional funds for the program.
County Administrative Memorandum B-3 provides, in relevant part, that “[r]eceipt of each gift or bequest having a value of more than $2,500 or with significant conditions or stipulations shall be acknowledged in writing by the department head and referred to the Board of Supervisors for acceptance or rejection.” Staff recommends that the Board accept the $10,500 donation from the Foundation to establish the Sam Francis Arts Fund.
Staff further recommends that the Board approve an ATR in the amount of $10,500 by transferring such amount to the Office of Arts and Culture.
COMMUNITY IMPACT:
Establishing the Sam Francis Arts Fund will help support youth arts programming in San Mateo County.
FISCAL IMPACT:
Approval of the ATR will recognize the revenue referenced above. There is no additional new county cost associated with this action.
