Adopt a resolution authorizing a second amendment to the agreement with Todd Finnemore, PsyD, for capacity evaluation services, adding $150,000, for a total amount not to exceed $350,000, with no change to the term of the agreement.

BACKGROUND:
Aging and Disability Services (ADS) provides a wide range of services to assist seniors, people with disabilities, and dependent adults to live as safely and independently as possible in the community.
Within ADS, Adult Protective Services (APS), the Elder and Dependent Adult Protection Team (EDAPT), and Probate Investigation (PI) Unit assist adults 60 and older and dependent adults ages 18 through 59 with disabilities when they are unable to meet their own needs or are victims of abuse, neglect, or exploitation.
Some APS/EDAPT/PI clients require capacity evaluation services to assess their capacity to handle basic daily living activities, more complex activities of daily living, and/or their ability to create a will or trust, manage finances, and/or make medical decisions. These evaluations may support petitions for probate conservatorship and/or be used in criminal investigations and court cases. Capacity evaluations also help ADS staff determine the appropriate level of intervention and support needed to protect clients from abuse or self-neglect while maximizing clients’ right to self-determination in the least restrictive setting.
In July 2024, ADS issued a Request for Proposals for capacity evaluation services. Todd Finnemore, PsyD, was among the selected providers.
On October 22, 2024, this Board approved an agreement with Todd Finnemore PsyD, for capacity evaluation services in the amount of $200,000 for the term of November 1, 2024 through October 31, 2027.
DISCUSSION:
Due to increased demand for capacity evaluation services, ADS recommends increasing the agreement amount with Dr. Finnemore by $150,000, for a total amount not to exceed $350,000.
The amendment and resolution have been reviewed and approved by the County Attorney as to form.
The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).
It is anticipated that approximately 30 APS/EDAPT and PI clients will receive capacity evaluation services in Fiscal Year 2027-28.

COMMUNITY IMPACT:
Capacity evaluations are typically conducted by clinical professionals experienced in evaluating a person’s capacity to make decisions through psychological testing. This agreement will positively impact vulnerable older adults and dependent adults receiving services through ADS’s PI, APS, and EDAPT programs. The APS, EDAPT, and PI programs serve clients who are 13% Asian/Pacific Islander, 4% Black, 40% White, and 11% Hispanic.
Contractors are expected to provide cultural and linguistically appropriate services, including the use of professional interpretation services during evaluations when needed. In addition, older adults and dependent adults receiving services from APS/EDAPT or PI may receive a neuropsychological evaluation regardless of insurance status or ability to pay.
FISCAL IMPACT:
The term of the amended agreement with Todd Finnemore, PsyD, is September 1, 2024, through October 31, 2027. The amount of the agreement is increased by $150,000 for a total amount not to exceed $350,000 for the 37-month term. Funds in the amount of $150,000 have been included in the ADS FY 2026-27 Adopted Budget. Of this amount, approximately $75,000 (50%) will come from CDSS federal funds, with the remaining $75,000 (50%) being Net County Cost.
