Adopt a resolution authorizing the County Purchasing Agent to issue purchase orders to Clinical Micro Sensors, Inc. dba GenMark Diagnostics, Inc. to provide laboratory test kits for the term of August 1, 2020 through July 31, 2024, in the amount not to exceed $1,000,000.

BACKGROUND:
As part of the County’s commitment to public health, San Mateo Medical Center (SMMC) purchased GenMark Diagnostics, Inc.’s (GenMark) multiplex molecular diagnostic equipment (ePlex) in May 2020, to increase SMMC’s laboratory testing capability. The ePlex equipment was selected for its ability to integrate the entire process from order-to-report to better realize the patient and laboratory benefits of rapid, multiplex molecular diagnostics.
DISCUSSION:
In order to utilize the new ePlex equipment, SMMC will need to purchase test kits from GenMark. These kits will allow SMMC to perform positive, negative, and pathogen testing to help determine patient antibiotic usage levels and assist with determining patient’s length of stay. In addition, this will allow SMMC to perform in-house respiratory pathogen panel testing, reducing SMMC’s need to send such tests over to the County’s Public Health Lab (PHL), which in turn frees up PHL resources so they can assist with other Countywide needs for their services. GenMark is a sole source provider for the test kits used with the ePlex equipment. Therefore, SMMC is requesting the Board waive the Request for Bid process allowing the County Purchasing Agent to issue purchase orders for the test kits used with the ePlex equipment.
The resolution has been reviewed and approved by County Counsel as to form.
The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).
It is anticipated that SMMC will be able to perform 75% of its respiratory pathogen panel testing in-house.

FISCAL IMPACT:
The term of the agreement is August 1, 2020 through July 31, 2024. The amount of the agreement is not to exceed $1,000,000 for the four-year term. Funds in the amount of $229,167 are included in the SMMC FY 2020-21 Recommended Budget. Funds in the amount of $250,000 are included in the SMMC FY 2021-22 Recommended Budget. Similar arrangements will be made for future years.
Expenses at SMMC are covered by fees for services or third-party payors whenever possible. The portion of expenses for services provided to the medically indigent or to those covered by programs that do not meet the full costs of care is covered by the County’s General Fund contribution to SMMC and is within the existing annual appropriation.
