B)                     Authorizing the County Executive, or their designee, to execute and record, such documents as may be necessary to effectuate the acceptance and transfer, including but not limited to the escrow instruction, certificate of acceptance and grant deed.

BACKGROUND:

San Bruno Mountain State and County Park (“San Bruno Mountain”) is in Northern San Mateo County, and is bordered by the cities of Brisbane, Colma, Daly City, and South San Francisco.  San Bruno Mountain is approximately 2,500 acres in size and provides world class hiking with views of the San Francisco Bay, Peninsula, and City of San Francisco, diverse and unique habitat and natural features, opportunities for picnicking, an open lawn, and an interpretive pavilion.

 

Complementing its recreation resources, San Bruno Mountain is home to 14 species of rare or endangered plant life, as well as host and nectar plants of endangered butterflies.  A Habitat Conservation Plan, adopted in 1982, helps ensure the protection of the endangered species and their habitats. Four federally listed endangered butterflies - the Mission Blue, Callippe Silverspot, San Bruno Elfin, and the Bay Checkerspot - and a variety of rare plants, are present within the San Bruno Mountain Habitat Conservation Plan (HCP) area.

 

Under the provisions of the San Bruno Mountain Habitat Conservation Plan (“HCP”), the owners of the land were required to dedicate certain parcels to the County of San Mateo for inclusion in San Bruno Mountain County Park as Conserved Habitat. Since that time, a number of parcels have been dedicated and are now incorporated into the San Bruno Mountain County Park and the HCP. The subject property for dedication and transfer to the County consists of two parcels, Parcel B and Parcel C, that together make up the prime butterfly habitat that was conserved by HCP Amendment 5.

 

DISCUSSION:

Toll Brothers, the owner of Parcel B and Parcel C, has now offered these parcels for dedication to the County in accordance with the terms of the HCP. Parcel B (74.53 acres) and Parcel C (3.74 acres) are the remaining parcels to be incorporated into San Bruno Mountain. The first of the three parcels, Parcel E, was offered for dedication by Brookfield Northeast Ridge II, LLC, and was accepted by Board Resolution No. 72083 on July 24, 2012.

 

The total land offered for dedication will consist of approximately 78.27 acres.  A 1995 maintenance agreement regarding private slope and drainage facilities specifies that subsequent purchasers, as the successors in interest in this agreement, have responsibility for maintaining stormwater drainage facilities.  It is therefore understood through this agreement that the Landmark at the Ridge II and Viewpoint at the Ridge Homeowner’s Associations will maintain the concrete drainage ditches and drainage devices within Parcels B and C and by agreement are to maintain a 30’ wide fire buffer around the boundary of Parcels B and C.

 

On September 16, 2021, the City of Brisbane Planning Commission adopted Resolution 2021-GPC-1, which made a finding that the acquisition by the County of these parcels is in conformance with the City’s General Plan.  The Resolution also found the acquisition of the Property is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to Sections 15301 and 15307 of the CEQA Guidelines, and that the exceptions provided in Section 15300.2 do not apply.

 

The County contracted with AEI Consultants, who carried out a Phase I environmental site assessment and found no presence of either recognized or controlled hazardous substances or petroleum products.

 

Toll Brothers has conveyed funds totaling $14,394.44 to the City of Brisbane for the County’s Parks Department to make future trailhead improvements at Checkerspot Drive.  Upon the transfer of the property to the County, Brisbane will convey these funds to the Parks Department upon close of escrow.

 

Toll Brothers will convey $127,504.06 to County Parks to conduct control of non-native and native shrubs, as well as invasive or exotic plant species in identified priority habitat restoration areas to enhance habitat for protected butterfly species. 

 

COMMUNITY IMPACT:

Approval of this resolution will contribute to the Shared Vision 2025 outcome of an Environmentally Conscious Community by promoting collaboration with other public and private entities to ensure environmental stewardship of important natural resources through cooperative efforts throughout the County of San Mateo.

 

FISCAL IMPACT:

Toll Brothers will transfer the sum of $127,504.06 to the County for County Parks to perform habitat restoration. The City of Brisbane will convey to County Parks the sum of $14,394.44 for trailhead improvements. This action will incorporate additional lands into the County Parks and thus require some incidental expenditure. The property is unimproved, and because it is located in the Habitat Conservation Plan area, it may require future exotics control work under the HCP, but such work will be an obligation of the HCP Trust Fund, which is funded by annual assessments imposed on development in the HCP area.
