BACKGROUND:
Job Order Contracting (JOC) is a task-based method of project delivery whereby contractors (e.g. general, mechanical, electrical, utilities or road contractors) agree to perform various construction tasks for a set fee. JOC has been extensively utilized at the federal, state, and local government levels for over 26 years.
On August 4, 2020, this Board approved Resolution No. 077667 which authorized the agreement with The Gordian Group, Inc. (Gordian) to develop, implement, and support the JOC eGordian system for the Department of Public Works (Department) for a term of August 8, 2020 through August 7, 2023 with a not-to-exceed amount of $500,000.
On October 18, 2022, by authority of Resolution No. 077667, the Director of Public Works executed Amendment No. 1 increasing the not to exceed amount by $25,000 for a new not to exceed amount of $525,000 with no change in term.
On January 3, 2023, this Board approved Resolution No. 079403 for Amendment No. 2 increasing the agreement with Gordian by $250,000 for a new not to exceed amount of $775,000 and extending the term through August 7, 2025.
On April 3, 2023, by authority of Resolution No. 079403, the Director of Public Works executed Amendment No. 3 to add a proposal service fee on a project to project basis with no change in the not to exceed amount or term.
DISCUSSION:
The Department is recommending an amendment to the agreement with Gordian and its proprietary software system, eGordian, to remain the sole provider to track and manage the County’s JOC contracts. The eGordian software has been customized for the County’s JOC needs.
The JOC Program, through Gordian, has been utilized over the last year to perform unanticipated emergency response, repair, and restoration work required as a result of damages caused by the early 2023 winter storms, work on the County’s supportive housing projects, and for projects in the approved Capital Improvements Plan.
The Department is requesting to amend Gordian’s agreement for an additional $600,000 for a new not to exceed amount of $1,375,000 with no change in term to fulfill the anticipated and unanticipated JOC construction tasks through the term of the agreement.
County Attorney has reviewed and approved the resolution and amendment as to form.
FISCAL IMPACT:
Amendment No. 4 to the Agreement increases the not to exceed amount by $600,000 for a new not to exceed amount of $1,375,000 with no change in term. Funding for this amendment is included in the Capital Projects Approved Budgets for FYs 2023-24 and 2024-25.
There is no additional impact to the General Fund.
