BACKGROUND:

In the course of law enforcement activities, it is necessary to gather forensic evidence to aid in the prosecution of individuals accused of a crime.  Evidence can be gathered in many ways including withdrawing blood from individuals suspected of driving under the influence of alcohol or drugs; individuals involved in a motor vehicle collision; and public safety personnel involved in critical incidents such as an officer involved shooting.

 

DISCUSSION:

In August 2019, the Sheriff’s Office issued a Request for Proposal (RFP) for the provision of forensic phlebotomy services, and Bay Area Phlebotomy & Laboratory Services was selected as the best qualified firm. On December 3, 2019, the County entered into an agreement for the provision of forensic phlebotomy services for the term of December 1, 2019 through November 30, 2022 in an amount not to exceed $340,000 (Resolution No. 077107). The agreement also included the option to extend the term by up to an additional two one-year renewals thereafter.

 

In December 2022, Amendment One to the agreement was approved which extended the term of the agreement and increased the County’s maximum fiscal obligation by $25,000. In February 2023, Amendment Two to the agreement was approved which increased the County’s maximum fiscal obligation by $250,000 (Resolution No. 079452).

 

The Sheriff’s Office would like to further amend the agreement to exercise the second and final one-year extension and increase the County’s maximum fiscal obligation under the agreement by $250,000. This increase is based on the average monthly volume of blood draw requests which is approximately 110 draws.

 

Approval of this amendment will ensure continuity of forensic phlebotomy services including, but not limited to, the collection of blood specimen evidence to be used in the prosecution of individuals accused of driving under the influence and other crimes.

 

The resolution and agreement have been reviewed and approved as to form by the County Attorney.

 

FISCAL IMPACT:

This amendment increases the contract amount by $250,000 for a total not to exceed amount of $865,000 for the term of December 1, 2019 through November 30, 2024. The cost of these services is shared between the Sheriff’s Office Forensic Laboratory and the Laboratory’s client agencies. Funding for this contract has been included in the Sheriff’s Office FY 2023-24 Adopted Budget. There is no additional Net County Cost.
