B)                     The Parks Director, or the Parks Director’s designee, to execute amendments to the terms and/or services of the agreement, so long as the modified term(s) and/or services is/are within the current or revise fiscal provisions.

BACKGROUND:

The Realize Flood Park Project (“Project”) is a comprehensive overhaul of the facilities and amenities within Flood County Park. After a robust, multi-year public engagement process, the Parks Department (“Department”) prepared a Project landscape plan inclusive of new sports fields and courts, picnic and reservation areas, a playground, walking paths, and utilities.  The parking facilities, restrooms, and landscaping will also be improved. 

 

To construct the much-anticipated facilities in a timely manner, the Project will be implemented in phases. Phase 1 includes construction of the small multi-use sports field, tennis/pickleball courts, sand volleyball courts, basketball court, picnic and reservation areas, pump track, walking paths, and utility systems, as well as improvements to the existing parking lot and landscaping.

 

On February 27, 2024, the Board of Supervisors adopted Resolution No. 080189 which authorized an agreement with Jensen Landscape Contractor, LLC (“Jensen”) for the implementation of Phase 1. Specifically, Jensen is responsible for (i) demolition of the antiquated facilities, (ii) preparation of the park for construction, (iii) construction of the new tennis/pickleball courts, basketball court, sand volleyball courts, walking paths, picnic and reservation areas, and subsurface utilities, and (iv) improvements to the parking lot and landscaping. 

 

Given the unique process of installing an artificial turf sports field, the Department determined that it was appropriate to contract with a firm that specializes in these services.  To secure the installation services necessary and for a competitive price, the Department used the California Multiple Award Schedule (“CMAS”) program, which includes a series of contracts awarded by the State of California’s Department of General Services in accordance with Public Contract Code sections 10290 and 12101.5.  According to the State, CMAS “offers a wide variety of commodity, non-IT Services, and information technology products and services at prices which have been assessed to be fair, reasonable and competitive.” 

 

Furthermore, Public Contract Code section 10298 expressly authorizes counties and other local government bodies to contract with suppliers awarded CMAS without further competitive bidding. Consistent with this authority, as well as County Ordinance Code Section 2.83.050(e) and Section IV(B)(3) of County Admin Memo B-1 which authorizes the waiver of competitive procurement, the Department recommends that this Board waive the competitive solicitation process for this agreement with FieldTurf USA, Inc. (“FieldTurf”). FieldTurf’s CMAS Contract Number is 4-06-78-0031A.

 

In addition to being a supplier awarded CMAS, the Department selected FieldTurf as the firm that would supply and install the multi-use artificial turf sports field because of their experience installing high-quality fields in the San Francisco Bay Area.

 

DISCUSSION:

Pursuant to their agreement, Jensen is responsible for grading and leveling the site of the multi-use sports field and installing the concrete curbs.  Once that is completed, FieldTurf will inspect and accept the project site and construct the sports field’s subsurface support and drainage system and irrigation/watering system, before installing the artificial turf field. FieldTurf will also be responsible for off-hauling and disposing of any excess spoils or materials. 

 

The proposed agreement with FieldTurf is for an amount not to exceed $1,123,689, which includes the purchase of the artificial turf field and ancillary materials for the amount of $425,181 and the delivery of the aforementioned services for the amount of $596,355. The not-to-exceed amount also includes $102,153 as a 10% contingency. Installation of the field is estimated to take one (1) month to complete.

 

The County Attorney has reviewed and approved the resolution and agreements as to form.

 

EQUITY IMPACT:

Flood Park serves as the local park for the North Fair Oaks community, and the Project, inclusive of the multi-use sports field, will improve residents’ access to greenspace and modern park amenities. 

 

FISCAL IMPACT:

Costs associated with the installation of the multi-use sports field will be fully funded using grant funds received by the County of Santa Clara specifically for the creation of new recreational facilities to offset the loss of recreational opportunities resulting from Stanford University’s 2000 General Use Permit.

 

There is no Net County Cost associated with approving this recommendation.
